good advice there john, also I could be fearing the worst case scenario and she could have not maybe had a camera and it is just her word against mine. I know its all ifs and buts but just exploring all avenues.
Until/unless they present any evidence, just state that a driver cut you up in traffic and could have caused an accident, this was only avoided due to your alertness. If asked - State that a few words might have taken place, at the same time adding that (no aggression/obscene language was used), I would point out that in traffic it is quite normal to point out to the other person/driver (as in this case) that they were in the wrong, and could have caused an accident. It might also be worthwhile adding that it would seem that this person has taken umbridge, and still will not accept that in law.......she could have been held liable for her poor driving.
IGNORE THIS FROM CABBY JOHN! DO NOT UNDER ANY CIRCUMSTANCES COMMENT UNTIL YOU HAVE SEEN THE WRITTEN COMPLAINT AND HAVE ORGANISED REPRESENTATION!

REMEMBER THIS PERSON WHO IS LIKELY TO PURSUE YOU IS AN EX COPPER    I HAVE REPRESENTED MANY DRIVERS IN SIMILAR CIRCUMSTANCES TO YOUR'S AS A CERTIFIED TRADE UNION OFFICIAL AND COME ACROSS MANY EX COPPER OFFICIALS WHO WITHOUT EXCEPTION WERE DISHONEST, CORRUPT, VINDICTIVE, SCUM, HE WILL TAKE GREAT DELIGHT IN REMOVING YOUR LICENSE FOLLOW JOHNS ADVICE AND YOU ASSIST HIM IN DOING SO !

i HAVE PM'D YOU
TT, a little bit of hypocrisy on the above coming from you!

You consistently criticise drivers for not standing up for themselves/not having a go.......and then when they do.......you tell them to get someone to hold their hand!! Coppers are not necessarily all that bright, just treat this one with caution, and remember that no matter how nice he tries to come across......HE IS NOT YOUR MATE.

My experience of them is that they will try to put words into your mouth i.e. he might ask...how fast were you going? You might say that you cannot remember the exact figure but it was under 30 mph!He might then say....well give me a figure/a rough figure....was it 10/15 mph, 15/20 mph it is only to fill in the gaps etc - whatever figure you give him - he will find if a reason to hold/make a case against you, do not answer his way.......stick to non commital answers, no matter to how arsey he gets.

Personally speaking, I am confident enough not to need a helping hand. If that is not the case for you, (and that is not a slight on you), then perhaps you will have to go down the Solicitor route.......and that is very costly.

P.S. Reading your post (I started putting this together before you posted) I am surprised that you have straight away gone for a solicitor......unfortunately you will land up out of pocket no matter what happens......to me, that goes totally against the grain.

Anyway.......good luck.
With respect John i am expressing a PROFESSIONAL VIEW here, and my experience along with MrT's is keep sthum get representation.

Having dealt with very many of these cases i maintain that opinion!

I on so many occasions had to rescues situations created by drivers making statements attending interviews i eventually decided " if you make a statement or attend an interview on your own i will withdraw all representation" it worked .

Drivers with the best intentions so often made their situation much worse or even irrecoverable, they had to be stopped! They were !

Rest assured if i were in a similar situation personally i would not rep myself, reps need to be uninvolveld to take a constructive view of any problem.

I always respect your views John, and usually disagree with you and of course remember that as a former Publican and Cab Driver you have much experience to fall back on.

From recollection of a previous post on here I believe you are under no obligation (legally) to attend an interview with a licensing officer - basically you can tell them to get lost .

hiya its an interview with the licensing officer not committee, however it says on letter failure to attend can result in my licence being suspended/revoked.
I was hoping someone else would jump in and comment on whether you are required to attend an interview with a licensing officer.

I think, but again don't take my word for it, that the 'failure to attend can result in suspension etc' is just scaremongering - forcing you into thinking you have to attend the interview. I think it is more likely that if you don't attend then you might be put before the commitee and that they might revoke/suspend.

Actually, I think only the licensing commitee can revoke/suspend a licence and not just a licensing officer :?

If you don't turn up then matters can be discussed and options taken without your input. Maybe not right, but that's the way it is.

Depends on what rules apply in each licensing area, but LOs' can suspend or revoke, or suspend until licensing committee.

It's a bit confusing now because once a driver is suspended, he cannot be suspended again. So the option is either revoke or nothing.

In my area officers can suspend but only the full licensing commitee can take your licence off you.

i am not a lawyer but always thought it advisable to meet with one when requested to do so, failing to meet the officer and possibly clearing the issue there and then would NOT be considered by the Licensing Committe as good practice :D you refuse to attend time has to be found on the Ctts agenda which given its A straight forward issue will not amuse them plus of course if you get the ex copper clunt on hos own you can threaten him no end and frequently scare it off completely. THEYRE ALL TO$$ERS!!

As for being suspended i suspect it depends on the accusation no doubt he could in extreme circumstances get the Ctts Chair to take executive action/

I would attend a meeting as requested but of course alter the date timing if necessary the excuse being the Driver requires his Union rep to be present as is his right so the meeting takes place within the remit of MY THE UNION REPS diary which would be considered reasonable  i often spun it out for weeks should the Driver request it ,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,there more than one to way skin ex copper scum
