In the proper exercise of its statutory discretion under section 37 of the Town Police Clauses Act 1847 a licensing authority is obliged to have regard (a) to whether the applicant intends that the hackney carriage if licensed will be used to ply for hire within the area of that authority, and (b) whether the applicant intends that the hackney carriage will be used (either entirely or predominantly) for private hire remotely from the area of that authority.

(ii) A licensing authority may in the proper exercise of its discretion under the said section 37 refuse to grant a licence in respect of a hackney carriage that is not intended to be used to ply for hire within its area and/or is intended to be used (either entirely or predominantly) for private hire remotely from the area of that authority.

(iii) In determining whether to grant a licence under the said section 37 a licensing authority may require an applicant to submit information pursuant to section 57 Local Government (Miscellaneous Provisions) Act 1976 in order to ascertain the intended usage of the vehicle.

Based on that could a licensing authority refuse a license for a hackney carriage that predominantly was used for airport journeys when there is no airport in the area?

more for if I plate here but work in another manor

like (say) if you had a MM hack plate and worked 6 days a week on Leiceste which would probably mean you rented a PDA and ll your jobs would be recorded on Mercury Exels server (or suchlike)

Grandad your question is a loaded one,if the airport runs started in the licensing area of the vehicle probably NO,if the majority of the runs started outside the licensing area the answer would definitely be YES.

why would i want a hackney plate, rooflight, meter to do airport runs?

We have a chap here who does mainly airport runs for corporate clients and he has his vehicle plated as a Hackney. Actually he has 2 cars both plated as Hackney. One is a BMW that is only used for his airport work. Most of his clients are not from our borough.

I quickly found there's no profit in airport runs, just cash turnover. why work for nothing?

Absolutely. If you read this chaps website you can see how he tries his hardest not to make a profit by including all sorts of extras for free. Also, most people would see it as a bonus if you were taking a passenger to Heathrow and you had another pick up at Heathrow to come back. Not this chap though, He gives both customers a discount so he still gets the same money. He drives down the motorway at 55mph to save fuel and will not turn the aircon on.

BHX £69 for a 100 mile round trip.....i get more on a school run 5 days a week

The beamer is a hackney. he takes the top sign off to wash the car and yes the prices are for either the beamer or the zafira.
