Uber driver who won right to take holiday has request for paid time off denied

An Uber driver who won the right for its employees to take paid holiday in a landmark case has had his own request for time off denied.

James Farrar won last week's employment tribunal, which ruled Uber drivers are not self-employed and therefore should be entitled to the national living wage and paid leave. 

He celebrated by putting in a holiday request this week and posted a screenshot on Twitter, adding: “I just put in for my first paid holidays at Uber! Happy Days.” 

But then, a few hours later, Mr Farrar posted a second image of Uber’s response, telling him he could not take paid holiday until the court ruling had been appealed. 

Mr Farrar wrote: “Bad news from Uber. Just gotta keep working I suppose….”

The email read: “Uber are appealing against the recent Employment Tribunal decision and therefore until a final decision is reached we will not be intending to pay any holiday pay.”

It added: “Clearly, there is no obligation on you to turn on the app next week and therefore you are free to decide whether you are free to decide whether or not to take next week as holiday.” 

Mr Farrar said he had been hoping to take the week off to spend time with his family as his mother-in-law was visiting from America. 

There are around 40,000 Uber drivers in the UK who are currently not entitled to the national living wage, holiday pay or pensions.

The ruling has led employment experts to believe that other large-scale self-employed workforces could come under greater scrutiny under UK law. 

Uber is appealing the decision.

Of course they do but that said even if they didn't why pay holiday pay until you absolutely have to :wink:

I wonder what these drivers thought when they signed up?

I bet its nothing to do with employment rights and holiday pay.

Not sure about that.

If they paid up they would be inundated with claims, so by waiting till the Supreme Court judgement they have nothing to lose.

is the easy way around this just to ask the drivers for a weekly rent instead of taking a % off earnings?, i have absolutely no idea how this will work with a taxi firm, what do the drivers want ? min wage/paid hols ? surely if you got paid min wage for the hours you work, then paid fuel/ins/ repairs/badge /plate/crb/medicals , you will be left with fook all? or am i missing something :?

No you would still be working for that company, either in your own or their vehicle

It was a very sensible move ahead of the further appeals.

Uber cannot now say 'no one ever asked', and IMO a court will take a dim view of the 'he can turn his system off and have as much holiday as he likes' comments.

Uber's PR is as s**t as a s**t thing wrapped up in s**t.

No you would still be working for that company, either in your own or their vehicle



do uber own vehicles ? I thought the "partners" supplied their own based on a specification issued by Ufail

doesn't matter they have very deep pockets with which to grease the cogwheels of the parliamentary machine

I think the way forward would be for the inland revenue to get involved after all how much extra tax revenue would they get from 40000 employed drivers as opposed to self employed with probably less than half actually even registered as such with the IR

Personally I'm not convinced they do have deep pockets.

They may have a lot of debt, and they may have plenty of numpties investing, but outside of London I'm not sure they have a future in the U.K.

You lot are amazingly stupid surely if they PAID MrFarrars holiday pay they have admitted their liability to pay each and every driver on their books likewise #-o #-o
