Hi guys need some advise to challenge this revised hackney rates or is it a done deal
on the 20 July I received this email from licensing

Dear All

A consultation exercise is about to begin to look at changes to the hackney carriage fare structure.

The proposals are just that 'proposals' or 'suggestions', there is nothing determined at this stage and therefore it would be appreciated if any responses reflect that position.

In the past we have experienced issues with some drivers setting hares running and misleading other members of the trade and we would like this consultation exercise to be positive and considered with an open mind.

There are some changes which the trade may like , other changes proposed less so. Please look at the overall changes.

The public will also be consulted as part of this exercise to obtain their views.

The main changes are as shown below :
• Introduction of a 'dead mileage' charge of £5 for journeys starting more than 10 miles from the drivers home address/taxi rank location /PS contracts
• changes to tariff 1 2 and 3
Tariff 1 to reflect day time hours only 7am- midnight
Tariff 2 the late night time economy hours from midnight onwards to 7am
Tariff 3 to reflect main public holidays only and important dates such as New Years Eve
• Reduction in waiting time fare
• Small increase in initial flag price

We would like to have as many views as possible so please take the time to consider the proposals below and respond with your thoughts or further suggestions to the Taxi Hub email address

Responses should be received no later than 10 August 2017

If you are unclear on any proposal please email the Taxi Hub for clarification

Well heres the kick in the ***** The local Taxi meter Man informs us this proposal has been Gazetted in the local Rag without any input from drivers

I'm going to object as at a conservative Estimate it will reduce earning by 25% and we are already the cheapest hacks in area

Looks like there trying to shaft you by reducing the time,by if I'm correct instead of charging extra from 8pm there increasing it till midnight, you will obviously need the support of the trade to object, 2014 was your last increase so your way behind, your 290 in the league about as good as hull city at football,
£5.20 for a 2mile journey, so I would put your own fare increase in, go high as they always give you less and get others on board to support you.

Could that not be a case of a council setting a rate for another licensing area?

Waiting time should be the same as what you can earn when it is busy. Our waiting time is £12 per hour which is pitiful.

As this is a consultation to just say you are going to object is mad. What you should do is point out the bits that you don't like and propose an alternative solution. Most Councils only review fares at the request of the trade. Did any of the trade request this change?

Yeah I was thinking that.....but surely he would have found that out before going off half cocked.

65 Fixing of fares for hackney carriages.

(1) A district council may fix the rates or fares within the district as well for time as distance, and all other charges in connection with the hire of a vehicle or with the arrangements for the hire of a vehicle, to be paid in respect of the hire of hackney carriages by means of a table (hereafter in this section referred to as a “table of fares”) made or varied in accordance with the provisions of this section.

(2)(a) When a district council make or vary a table of fares they shall publish in at least one local newspaper circulating in the district a notice setting out the table of fares or the variation thereof and specifying the period, which shall not be less than fourteen days from the date of the first publication of the notice, within which and the manner in which objections to the table of fares or variation can be made.

Unless the notice is published in the paper, such notice is illegal, call the LGO

It has not been passed at a Council meeting nor it would appear requested by the trade,Taxi policy does not seem to give delegated powers to this Licensing Officer to review Tariffs(maladministration)
This declaration of intent by this Council Licensing Officer to alter the chargeable Tariffs has an implementation date attached.
Section 67 disqualifies one of the suggested Tariffs,do not think this Officer has read the relevant sections about Tariffs.

So the trade needs to object ....individually....so they can not say they have only one objection .
