Would be appreciated if persons on this forum could inform me as to whether their licensing authority keep and record the information in the method stated within the 1847 Town and Police Clauses Act?

When passing a comment on this subject please state your licensing authority.

I don't know what it says in the 1847 act but in Melton there are public registers kept and they are available to view online.

Any council that only records details of proprietors in a book, as outlined in the 1847 act, is a council not fit for purpose in 2017.

So I suspect the answer to your question is none. And quite rightly too.

Section 42 instructs a Council what they MUST do and what has to be recorded in the BOOK which is the register.

Councils are being allowed by the TAXI(hackney carriage)trade to get away with to much,a lot of comments on this forum are about minor infringements committed by drivers or proprietors where Councils have came down on them like a ton of bricks.
Non compliance by Councils with this Section of the Act is a very serious matter and the trade should be making those who are non compliant aware of the fact that everyone has to comply with the Act in its entirety.

Wirral Borough Council is online and good luck finding it. If there is a another form of record I have no clue cos I've never asked them.

We don't particularly like the public and solicitors being able to get hold of your private information i.e. name and address very easily, so maybe other areas like mine, make it as awkward as possible. Think of it this way, a cab is parked on the rank, bloke walks past, takes the taxis reg and plate number, and makes a note of the time. Next day wanders into a solicitors and tells the solicitor he got into that cab on that day and went from A to B. On the journey the driver braked sharply and he was thrown out of his seat and sustained injuries. (We know he should have been wearing his seatbelt, losing 25% of his claim), but he took the reg no. and the plate no. The solicitor then rings up the council and gets the owners name and address, and then the fun starts.

So maybe the trade reps have made it that hard, and even have to pay to get the owners details, could possibly be an explanation.

What I will add is that the Data Protection Act came after the 1847 act.

That's not what section 42 actually says.

All it says is that a register be kept of any convictions of owners, drivers or attendees to the specific hackney.

If the owners, drivers and attendees (whoever the f*** they are) are free of convictions then the book should merely show the plate numbers.
