The DfT issued guidance saying it would be good practice (or something like that) to do checks every three years, but didn't say if the police are late replying drivers should be put out of work.

If other agencies are indeed not fulfilling their legal duty then that is clearly wrong, however that is not an excuse to punish drivers that have complied with their legal duty to undertake DBS checks.
