There is a chap here who wants to run Trike Tours. His website says that he is taking bookings from 18th June 2018 but at this moment in time he has not been granted an operators license. Is he breaking the law? The Council have proposed a change to the policy to allow such a vehicle but it is still out to consultation.

Yes.

"operate" means in the course of business to make provision for the invitation or acceptance of bookings for a private hire vehicle

So he definitely hasn't got an operator's licence, as opposed to a vehicle licence?

I assume it's possible to be granted an operator's licence without specifying any vehicles at the time of application/grant.

But even assuming he does, there's surely a slight misrepresentation in his advertising at least if he's implying that he's available for tours when presumably all he can do is take a booking for the future conditional on being granted a plate for the vehicle at some unspecified time.

At the moment he does not have any licenses. There is a consultation taking place to see about changing the policy to allow a trike to be licensed and the operators licens is being held back until that is sorted because the operators license is no good if he can't plate the vehicle.
