A restaurant worker who was twice caught parked in a hackney carriage rank has been taken to court and fined.

Middlesbrough Council's Licensing Enforcement team took action against Rema Uddin after her car was found in a rank on Linthorpe Road on October 20 last year.

At 9.50pm, a council licensing enforcement officer approached the vehicle and wrote out a ticket advising the driver that it is an offence to leave a vehicle other than a hackney carriage on a hackney carriage stand.

The note said legal proceedings could be commenced, but added that an alternative could be considered if the driver contacted the Licensing Office within seven days.

The defendant Ms Rema Uddin, contacted the Licensing Office on October 22, 2018 and confirmed that she had been the driver of the vehicle.

During an interview on November 20, Ms Uddin said she had parked prior to the time the hackney carriage rank came into effect so she could go to work at a Linthorpe Road restaurant.

She said she had lost track of time during her shift meaning her vehicle was parked in the same spot after the hackney carriage stand became effective.

But according to Middlesbrough Council, records show that Ms Uddin was issued with a written warning on October 26, 2017 after committing a similar offence on August 26, 2017 for parking her vehicle at the same Linthorpe Road hackney carriage stand during the time of its operation.

The latest incident saw Ms Uddin, 20, of Sandringham Road, Hartlepool, taken to Teesside Magistrates' Court where she said that the only two times she has parked in the bay is the two times she has been caught and her written plea explained that she was also a student and had a limited income.

The court ordered she pay a £98 fine and £171 in costs and charges making a total of £269 - payable by all pay card at £5 per week, with first payment within 14 days and collection order made.

A spokesman for Middlesbrough Council said: "Designated hackney carriage ranks are provided only for licensed taxis enabling them to stand and ply for hire.

"It is important therefore that other drivers observe any parking restrictions shown on the signs displayed at these locations to avoid interfering with the services of taxis.

"As this case demonstrates, enforcement action will be taken should there be evidence of unauthorised car parking on hackney carriage ranks."

Mahrouf Hussain, chairman of Middlesbrough Hackney Carriage Association, said: "We are pleased to see the council are taking action against persistent offenders.

"Vehicles parking on hackney carriage ranks causes a major problem for our Members as it interferes with the operation of the rank, particularly at peak times when the town centre is at its busiest."

Our enforcement officer says neither he or the police have powers to carry out enforcement against non taxis only the traffic wardens

We're about the same. By which I mean about one ticket every 20 weeks. In fact I wouldn't be surprised if the average was closer to one ticket every 20 months



Maybe it's to do with decriminalised parking in your manor, but in Middlesbrough it's still a criminal matter rather than a civil law one?

Very surprised the council took the lady to court, maybe it was because it was a slam dunk as she admitted it under interview.

Best way to keep non taxis off ranks is parking tickets. Loads get issued down here.
