These three racist yobs attacked a taxi driver and trashed his cab - in a row over the fare

Three friends have been jailed for an ‘appalling and shocking’ attack on a taxi driver.

Shelby Marsh, Rebecca Unwin and Joshua Lovatt racially abused and physically assaulted the victim because he asked them to pay their fare upfront.

The trio, who had been drinking heavily for several hours at a house party, also caused serious damage to his vehicle - resulting in it being written off.

Stoke-on-Trent Crown Court heard the three defendants had been at a house in Cheadle and called cab company Lucky Seven at 3.30am to book a taxi back to Stoke-on-Trent.

An argument started when they objected to paying the fare prior to the journey, and the driver asked them to get out of the car.

Prosecutor Richard McConaghy said: “Unwin did get out but the other two stayed. When they wouldn’t get out the driver said he would call the police and pointed out that there was a camera in the car.

“At that point Marsh grabbed the camera and ripped it off, breaking it. She punched him to the face with a clenched fist and his nose started to bleed. Unwin then got back into the car and all three assaulted the driver. Some of the blows to the back of his head were from a bottle.

“The bottle was then thrown to the front of the vehicle and Marsh picked it up and hit the complainant in the forehead with it.”

The court heard all three made racist comments to the victim and 23-year-old Marsh told him to ‘Go back to Pakistan’. He managed to get out go the car, but 21-year-old Lovatt also got out and punched him again.

Mr McConaghy said: “All three defendants surrounded the driver and continued to punch him. Lovatt then kicked the wing mirror off the car and grabbed hold of the driver’s door and attempted to pull it off. Unwin kicked the car before smashing a wheelie bin into the side of it.”

When police arrived, having been called by a neighbour who witnessed the attack, the trio had gone back inside the house. All three tried to evade arrest, with officers having to use PAVA spray on Marsh and 24-year-old Unwin, while Lovatt was taken to the ground and arrested.

The court heard the taxi driver went to hospital with injuries to his nose and forehead following the attack, which happened on June 11 last year. The damage to his car was valued at hundreds of pounds to repair and he declared the vehicle an ‘economic write-off’.

All three defendants pleaded guilty to racially aggravated assault occasioning actual bodily harm and criminal damage.

Unwin, of Vivian Road, Fenton, and Lovatt, of Prince Charles Avenue, Leek, have no previous convictions while Marsh, of Watkin Street, Fenton, has 11 convictions for offences including battery, criminal damage, assaulting a police officer and breaching an Asbo.

Hamish Noble, representing Lovatt, said: “Mr Lovatt didn’t play a big part in the argument about the fare until later on and he was not the first to assault the complainant, although he did join in. He’s genuinely sorry and disgusted by his behaviour.”

Brian Williams, representing both Unwin and Marsh, said Unwin was ‘normally a decent, honest young lady who – in drink with others – behaved utterly out of character’. He added: “Miss Marsh has had a troubled background. Her offences are committed while in drink where she behaves appallingly. There must be a reason for that.”

Judge Paul Glenn rejected the advocates’ appeals for the defendants’ prison sentences to be suspended. He sentenced Lovatt and Unwin to 23 months in prison, while Marsh was jailed for 27 months. He said: “This was appalling and shocking. It was a sustained and repeated assault on a particularly vulnerable victim.”
