This double mention of passengers and omission of drivers would seem to imply that drivers are already banned. Or that drivers won't be banned. Or whatever

Presumably this is the proposed rule, but the report doesn't actually say so.
But if it is, then obviously the prohibition would apply equally to drivers
and passengers
