Technically the operator is the employer who is responsible for everything that happens on the circuit,if he says anyone wanting to be under his control by joining his circuit,they must supply an up to date DBS check,he is quite within his right to do so.
Legally the employer is who ever is named on the DBS certificate, and the are responsible to give advice to a third party, in this case a private hire company, to avoid any serious data breaches.
From the home office guidelines to whoever is named on the dbs as the employer.
Ensure any third parties are aware of the Data Protection Principles and provide them with guidance on secure handling and storage of information. For Data Protection purposes, information passed to a Registered Body by DBS remains the responsibility of the Registered Body even if passed to a third party.
