In this particular case the esscort is in receipt of his old age pension as well as his money from the job. The business owner is not registered as an employer.

Not being privvy to all the facts means im unable to make a judgement but if the guy is happy with £4/hr...

I totally fail to see how a driver doing a job for me can be self employed but an escort cannot be..

But that is the argument regarding all drivers are employees not self employed. Thus the operator/proprietor would have to pay for holidays, sickness benefit, national insurance and pension contributions.

Firm I work with has dozens of school escorts and they are all on the cards.

And get paid at least minimum wage and have 'workers' rights.

Try checking what an escort does against the criteria for being self employed. For instance can the escort pass his work to another person?

well, yes he could

Well most of leicestershires escorted contracts require a regular escort. Are you ssaying that if an escort can't work on a particular day they can send their mate without asking the contract holder first?

No they cannot not, contractor is the only person who can change escort and must inform school transport that they have, reason for doing so and ensuring the replacement has a permit.

look, whatever YOU think about it peter, firstly your figure of £4/hr if for the whole trip could be £8/hr if applied to "occupied" time (kid onboard) and second, you have no power to object, ask LCC for their thoughts/guidance..

lastly if the guy is HAPPY with his wage, who are we to stick our snouts in?

It was the chap and his wife that brought it up with us.
As for weather he is being paid "whilst occupied" is ridiculouss. If you are at work for 5 hours you are at work for 5 hours and even at your £8.00 for half the job it is still below minimum wage.
Please explain why I, if I wanted to, have no power to object or report it?
