 Post subject: Applying for a License

I am looking at starting out as a Hackney Driver in Derby.

i have spoken to the local Council and they are sending me my application pack out.

I am a little worried about the CRB check.

I have two cautions;

One from 2003 for Criminal Damage » I broke a door at my ex-wifes address following an argument.

One from 2005 for common assualt » Some dick threw a stone at my 3yr old son, so I grabbed him and threatened him. He gets off, I wasn't arrested, I went to the police station of my own free-will, and was given a caution for Common Assault. Great eh, I try and protect my own, and I get booked for it!

I am little worried as to how these may affect my application.

DCC have told me that I will need to go into a meeting beacuse of these with the licensing director.

Anyone else have a similar experience? How can this affect me?

Each council has it's own criteria, but if you go in and explain the full circumstances, then you should be ok.

Just tell them the truth, say they were two-offs and they can be 100% confident nothing like that will re-occur. :wink:

A caution is an admission of guilt, without the process of going before a magistrate.
You'd have problems here, but i wouldnt know about Derby.
Hope it goes ok,but the way they'll look at it is if you got a gobby punter would you smack him!

As the others have said, it depends on each LA, but I've no doubt you could have problems with some, particularly given that the offences were relatively recent.

But nothing we can tell you can really affect the outcome, so it's probably just best to wait and see what happens.

The 2003 one is nearly 3yrs ago.

As for the common assualt, I have never done anything like that before, just will not tolerate scumbags throwing things at my kids!

Dont mess with Me, My Missus, My Kids or my food!

If you are refused a license you can always appeal to the magistrates court.

Reading from the link below you may answer NO on your application form, see paragraph, "Cautions"

Probably by the time the application gets through the taxi dept.office wallars will have forgot what you said to them, old Yorkshire saying, Eat all, sup all, Say nowt, or is it pay nowt, forget.

I see no reason for not getting a licence, we have worse offenders driving taxis with lists as long as your arm, worse comes to worse the good old magistrates after you explain to the "Beak" of the bench, they will laugh it out of court and give the go ahead to get licence, can't see the Licening lot refusing you, you don't have any offences to your name, only a couple of "cautions" and they are nowt.

As for the CRB form, I think a No is in order.

The hackney application form asks if you any onvictions, and the name of the court it was dealt with by.

Well, it never went to court, it was dealt with by the custordy Sgt.

A caution IS an admission of guilt, so even though he didnt go to court to be convicted, he admitted whatever he was charged with and the custardy Sgt decided that was enough and not to refer it to DPP.

According to the CRB website a standard disclosure includes:

..details of all convictions, cautions, reprimands and warnings held on the Police National Computer (PNC)

To issue a caution a licensing authority must have enough evidence to prosecute in a court of law. But usually cautional offence is quite minor.

Thus a caution is viewed by many councils as a good way to save time and money by sorting it without going to court. But it will appear on your CRB.

I went before the "public protection commitee" twice to get my licence because of previous convictions.

Refused the first time , but got it when I reapplied !!

Dress smart and dont act too cocky, and if you can, write out a statement explaining your circumstances and read that out (unless your good at public speaking and can do it off the cuff, which im not and got a bit tongue tied when I first went up and made myself look a complete tit !!!)

forgive me for being nosey, and tell me to Mind it.. if you wish, but were you're previous convictions dealt with in the court, or were they cautions?

What were they for?

Just so I can either worry about not getting approved or set my mind at ease?
