Exemptions from seat belt wearing

The legislation provides for a number of specific exemptions from the seat belt wearing requirements on medical and other grounds. Please consult your doctor if you think you should not wear a seat belt on medical grounds.

As for the others these include:-

(g) the driver of—
(i) a licensed taxi while it is being used for seeking hire, or answering a call for hire, or carrying a passenger for hire, or
(ii) a private hire vehicle while it is being used to carry a passenger for hire;

It should say: the driver of a licenced vehicle IN HIS OWN LICENCING AREA.
Outside of your area it must be worn.
Hac's dont need one at all in their own area, but PH have to wear them if the car is not hired.

i think these days you would have to be a bit thick to not want to wear your seat belt, especially with the mileage you do each year.

Not too sure about that Mr Smiffyz. The act isn't council specific.

Of course a cab can't ply in a different manor, so you are right there, but a PH can pick up from anywhere and drop off to anywhere.

My recollection was that some mention of area was made, and of course a HC can do pre-booked work outside its.

However, I can't find anything about it on the web (there are plenty of mentions, but they don't mention the area - on the other hand, most seem to be copied from the same source), but I found this interesting nugget from when the House of Lords discussed the exemption a couple of years ago:

I suspect that that was included in legislation when the seat belt law was passed simply because the taxi driver lobby was effective and threatened all sorts of reprisals against politicians whom they carried around London unless they were granted that exemption.

Have a play about with this, click on each passenger at the end of demo, vary the road speed, passengers, etc etc
Remember whether the passengers have seatbelts on or don't bother to wear them, it will be you they will claim on in the event of an accident, I work like this, if they don't put them on I don't set off or they get out, I wear mine all the time, they work in conjunction with the airbags.

I got a £30 fixed penalty last year ONE MILE from Warrington (my area) for not wearing one.

It is true, hacs not at all in their area.PH not needed if carrying a fare paying passenger in their area.
Outside the licencing area all must wear seatbelts.

But if HC is 'answering a call' (e.g. meeting a flight at Heathrow to take back to, say, Basingstoke) Is he exempt under the Act?

They way it was explained to me by the plod who pulled me was " Hac and PH, if your outside your licencing area you must wear your belt. Fare on board or not.

Going a step further, kids. How many carry a booster cushion? All kids under 8 (AFAIK) must sit on a booster cushion, and all babies must be in a purpose made safety seat. No kids under 12 are allowed to sit in the front.
