One of the students on on one of our school contracts is refusing to wear a face covering stating that he is exempt. The driver and escort are not at all happy with this because they say he is putting them and the other 2 students in the car at risk. I have asked County hall for clarification on what would happen if the driver and escort decided that they were not going to have the student in the car without a face covering. The immediate response was that they would have to carry the student. My response was "so you are saying that the staff must choose between their health and their job?" The chap was not at all pleased at that. I pointed out that I had a duty of care towards my staff and the other students in the transport and just because the student may be exempt from wearing a face covering, he wasn't exempt from catching and subsequently passing the virus to my staff and the other students and who would be responsible should that happen?
So far no reply to that.
Any views?

Suggest you inform them that you are not going to carry this student stating that it is a health and safety risk. Ask the Authority to supply individual transport for this student.

Guidance for our trade states masks must be worn, if a person claims to be exempt we can refuse to carry them,

My granddaughter is exempt from wearing a mask, she has asthma, but she is not exempt from wearing the plastic face Screen, which stops the spray of the bacteria

basically they will not insist that a face covering/shield must be worn so either continue with the possible risk or lose the job.

You need to get a reply to that.

Suggest you inform the council that this student, and any other student that doesn't wear a mask, needs to go in a screened vehicle.

But in the end it's down to you.

Is there a way the lad can have a daily lateral flow test?

What happens at school? Do they allow him to be mask less all day?

This reminds me of when many years ago I was on my two-man crusade to get the council to mandate CCTV. A very successful crusade I may add.

Anyway had a meeting with the council and the trade where the council's head honcho complained about CCTV being a privacy breach.

I then reminded the head honcho of how many CCTV cameras had followed me from the council's reception to the meeting room.

I think from then it became a three-man crusade. :D

It is a school where the "naughty" kids go. Their every need is pandered to.

our school contracts say we cannot refuse to carry pupils should they refuse to wear face masks

Our Council says that if someone says they are Exempt from wearing a Mask then we have to accept their word for it.
