As we all know the councillors who are members of licensing boards have enormous power over the daily lifes of taxi/private hire drivers & operators

Indeed they have the power to take away our livelihood if they decide we are not 'fit and proper persons'

The question I ask is how can we know they are 'fit & proper' & qualified to judge us ?

Do Councillors undergo background checks & criminal record checks ?

Some might say the electorate have decided they have the suitable qualifcations but what information do the electorate have ?

I'm pretty sure they do have CRB checks. But if there is something iffy in their past then their political opponents will make dam sure it gets to the press.

As for their qualifications, well in all fairness if they had any decent qualifications then they wouldn't be councillors.

well the same kangaroo court applies here in fife as with the rest of the country especially regards speeding. what i would like to know is do they(and i have heard you are up in front of 10 of them) all hold a clean licence and if not what right do they have to revoke a licence application? Now a driver up here was recently done on a hand held camera at 57mph in a 30 zone at 3pm and rightly deserves to have the book thrown at him, or be issued with a restricted badge if he can pove it was a "one off" after many years conviction free driving, but for many of us its more the case of 1 or 2mph over the limit, a conviction that is issued daily to many thousands of drivers with the ever incresing amount of cameras, guns, specs and vans that are out on the roads today. What right do they have to castigate and endanger our livelihood when a percentage in thier "courtroom" have or already hold on their own licence? Is this something that would be avalible under the freedom of information act?

Don't know about your part of Fife broxibear, but up here apart from the odd camera van that's about it really - and since I usually work nights, when I don't think they come out much, I've only seen one speed trap of any kind for a couple of years. I don't think there are any fixed speed cameras in Fife at all, and the nearest ones are the other side of the Forth Bridge and north of Dundee on the trunk road to Aberdeen.

I've never heard of anyone being done for being 1 or 2 mph over the limit, is this common? I thought it was usually 10% at least.

BTW, I'm talking North East/St Andrews in particular.

I pulled 2 of them up on Friday night and told them they are breaking the law and I would speak to the inspector if the did not do there job by the book, IE stand well out in the open, where they can be seen and hold the gun with both hands,they pulled me but could not find nothing wrong, having just been inspected by the vehicle inspectors 2 weeks earlier, 120 cabs passed the inspection by the way and 3 where given warnings for bulbs 1 for a tyre on the limit

I don't think they're breaking the law by enforcing it , and I think these are just guidlines which they presumably don't necessarily have to adhere to.

After all, if they did what you wanted then if everyone was paying attention then no one would ever be caught speeding, thus there would be no point in having speed limits?

ACPO guidlines state that the Officer must use the gun to confirm his opinion that your speeding, not just point at every car that passes, so hiding in a bush, jumping out and doing you shouldnt happen (in England anyway) if it does, then theres lots of case law to show that speeding fines have been thrown out.

I don't know much about this, but a story in the Dundee Tele tonight says that councillors in Angus are to be vetted soon.

Reading between the lines it looks as if it will only come in after the next election and will only be compulosry for child-related duties.

I wonder who will decide whether they pass or not, or maybe the councillors will be judgeing thier peers for a change.

BTW, I think Disclosure Scotland is the same as the CRB.

Councillors to be vetted

Checks on all Angus councillors are to be mounted to ensure they are fit to carry out child-related duties.
The councillors opted against waiting until the next election to undergo enhanced Disclosure Scotland tests and agreed to be put through the vetting process immediately.
Members of the strategic policy committee backed the move inspired by Councillor Iain Gaul, who felt the checks should apply across the board — and not solely for those with direct involvement in issues dealing with children.
