hi guys ,i'm new to this but need some advice.i submitted my new vw touran for a ph test,and was refused cos the back seat did not measure 48"(it was 40"across 2 seats).this rule is 20+ years old and was intended for cars not 6 seaters.i have already had a vw sharan licensed for 4 years,and it is below the 48" standard there are quite a few 6 seaters licensed:zafira,sedona and galaxies ,none of which meets the measurement.they made me remove the two rear seats(probably screwing my warranty)and gave me a 4 seat license ! i could have saved £5000 and bought a skoda !! my question is:do i walk away and accept this(no chance),throw a fit and demand all other 6 seaters get recalled for the same treatment,or have them for discrimination/victimisation?

The first thing you have to do is to ask the council where in it's rules it stipulates that specific rule. Many LOs have many rules that they have made up themselves.

If that is the written rule, then your only option is the mags court, or whatever it's called up there. Will cost you a few quid, but that's something only you can decide on.

Of course you could go to your local councillor(s) and ask if they could change this stupid rule.

None of these are easy, but if you keep banging on at your council, well you just never know. :wink:

Just call back and ask to be licensed for five , and tell them the back seat is for extremely fat disabled people..... :wink:

Same problem with our LO, but if they already have some licenced as you say, then just point this out and ask what their going to do about these.
Ask to see the date the rule was changed because if they renew the existing vehicles and have not stipulated a time for them to comply, then an appeal to the Mag's is in order. And i think you'd win.

You should argue on the grounds of fair and resonable policies.

They already licence 6 seaters which do not meet the criteria so why not yours.

I would suggest (and my zafira is licensed for 6 after appeal) that instead of demanding your vehicle is licensed ask why the council allow the others.

Be persistant ........................ because persistance beats resistance.

:? thanks guys for your help.i'm setting up a meeting with a member of the licensing board as it seems the enforcement ](*,) officer is doing this on her own and it has not gone before the committee.will keep u posted.
