Location: BRIGHTON & HOVE
For the record this lady lived in one LA and worked in Brighton. As she worked in Brighton I persume she has the option to complain to that LA.

If you ever make a complaint to a MP the first thing he/she will establish is which Ward you are in. and then send you to the appropriate MP . the same goes for Councillors.

you are private hire are you not?
When you look in the trade magazines you see plenty of wheelchair accessible private hire vehicles, so why are the private hire not buying vehicles to clover this woman's needs.?

A council can't force private hire owners to buy wheelchair accesible vehicles, can they?

Mr Brightonbreezy .................. you are suggesting that cost is a factor that stops you from purchasing a WAV.

Please be assured that a Fiat Doblo WAV is actually cheaper to purchase and insure than many other vehicles consistently used as private hire vehicles. They are equally as fuel efficient and have very comparable servicing and running costs.

No-one has suggested, as far as I'm aware, that a PH WAV must be any vehicle type although I would suggest that a LTI or Metrocab vehicle would be unsuitable for use under the 76 Act so must be removed from the list of available vehicles.

For the record I know that a Fiat Doblo can be purchased as a WAV for under £13,000 BRAND NEW which if taken on credit terms would equate to less than £60 per week.

I would suggest therefore that your claim that having a PH vehicle would not be viable because of their cost is untrue and therefore offered only as an excuse for you to get what you want.

No, at the moment, they cannot .................... however if we are going to have a level playing field and all be treated equally do you not agree that PH operators should have the same legal obligation as the HC trade.

Or are you condoning a "one rule for some and a different rule for someone else" scenario.

Like I've always said, we can only work within the law. If the Government ever change's private hire legislation to conform with hackney carriage legislation then that is another matter but until then, people will have to reconcile themselves with the reality of the situation.

But people are not, people are trying to change the laws that don't suit.

The fact remains JD that the reality of situations that effect the majority are not being recognised as such.

What I hear when you state "Like I've always said, we can only work within the law" does not ring true. I say this because section 75 allowed certain activity which was undertaken within the law YET you supported the removal of section 75.

If you truly believe "Like I've always said, we can only work within the law" then you could have under any circumstances taken the action you did with regard section 75 and I don't think that my request for an explanation is out of order.

But as you NEVER answer questions and only ask them I will not wait for a straightforward reply.

With regard the licensing of PH WAV's ........................ surely every identified market should be utilised to its full potential.

If a driver thinks that they can make more money by having a WAV then surely it would not matter which plate or licence was attached to the vehicle.

The reality is that the people seeking WAV HC do so to work as a HC and most shy away from wheelchair work whenever possible. In Gateshead last Sunday morning there were at 02:30 40 wheelchair accessible vehicles outside our only nightclub, yet at 18:00 I could not get a WAV to pick up a disabled relative who didn't feel well from a family party.

When at last I found a WAV which could it was a PH vehicle from a neighbouring restricted area ...................... now in which area do the public or the disabled community get a better service.

But Brighton Council seem to think they can force new Hackney Carriage Proprietors to license a WAV, and subsequently turn that Hack into a Private Hire vehicle by imposing a condition where they must join a circuit, and must accept all bookings when told to!

To all aggrieved WAV owners in Brighton, I would say, form your own circuit, utilising www.taxi-call.info/ Set up will cost you less than one weeks circuit rent, and you will be your own masters.
