Well I suppose it's all down to what happens at the destinantion.

If they do a runner, or attempt to do one, then that's evidence in itself.

If they check their pockets and apologise, giving full name and address details, then that should get them out of the theft bit.

Of course it all comes down to whether they had criminal intent - ie a guilty mind, or mens rea.

If they have genuinely lost their money (say) then there's no criminal intent, but if they know they don't have money and intend to run off then clearly that's a different matter.

But of course the real difficulty is proving these things, but if decamp from the car quickly then that's a good start evidence-wise.

One thing I once did on a late night fare which they could not pay was to take a gold chain as insurnace of receiving the fare the next day.

Is this allowed or is it breaking some kind of law?

You could have a bit of bother if they went to the police and claimed you stole it.
