Can someone more learned than me point me to where a council can or cannot impose retrospective conditions on driver licensing conditions.

Secondly, are there any challenges to retrospective conditions being made at the moment.

Any assistance would be gratefully recieved.

I take it this is in respect of private hire driver conditions?

This would be for either Hackney or PH driver licensing conditions

Section 51 of the LGMPA 1976 deals with licensing of drivers of private hire vehicles.

Conditions can't be placed on a hackney carriage drivers license except by way of Bylaws.
