This is another trial featuring live updates, so has to be read from the bottom upwards. So like the guide dog refusal trial the other week, but perhaps this more serious case is a bit more worthy of this kind of coverage. Still pretty unusually detailed reporting though.

And trial will last several days, so this is just the first day's worth of evidence.

A man accused of a sexual offence against a woman on Christmas Eve 2017 is to stand trial.

Arfan Ali, 28, denied one charge of causing a person to engage in sexual activity without her consent at Teesside Crown Court on September 14 last year.

A three to four-day trial is scheduled to start today.

Ali, of Marton Road, Middlesbrough, had been bailed last year by Judge Simon Bourne-Arton QC, the Recorder of Middlesbrough, until the trial.

Jury sent home for the day

Her evidence has finished and she has been released.

There will be no more live witnesses today and the jury has been released and will return on Wednesday morning.

How injuries happened

Judge Ashurst asks her about her injuries and whether she has any recollection of how they came about.

She says she does not and that she only became aware of them when she went in the bath the next day.

'Why would I do that to someone I don’t know?'

Mr Gatland says that she then “rubbed his leg with your hand”.

She denies this saying:

"He is a taxi driver, why would I do that to someone I don’t know?"

She says she doesn’t remember saying to him “text me tomorrow” - something Mr Gatland says she did.

She says that she now believes she may have been spiked in the bar she was drinking in in Yarm, but agrees he would not have been the person that did this.

Mr Gatland asks her how Ali knew personal bits of information about the woman’s life if she was in no fit state.

She says that she was not in “a capacity to consent” and has no recollection of what was said in the taxi.

He says that at first, the woman “didn’t think anything inappropriate had happened” until speaking with friends.

She denies this saying she had injuries which you don’t get from sex.

Alleged victim is now giving evidence

The alleged victim is now giving evidence. Mr Gatland now asks how “aware” she was when in the taxi before she was dropped off.

She says she has “no recollection”.

He asks that at the end of the taxi journey “you asked him for his number and you put it into your phone” she says she has “no recollection of that” and adds:

"He had a job to drop me off at home he didn’t have a job to sexually assault me."

'Something didn’t feel right'

She says that after many messages between them, she then wanted to distance herself away from him.

But before that she says she “can’t remember if it was me or him” that raised the question of meeting up she still wanted to “thank him personally” for “looking after her” and she “couldn’t believe he’d lie” as he “seemed so genuine”.

She then saw scratches on her arms and legs and was “really sore and itchy” and “something didn’t feel right”.

The jury has finished watching the police interview and are now handed photographs of the scratches and bruises that were on the woman.

Became more wary

She agreed that she “initially thought he had protected” her and was even wanting to thank him in person over a coffee.

But after friends spoke to her she and raised their concerns, she became more wary herself.

'A lot more serious'

The jury hears that after examinations, Ali’s semen was found on the girl’s underwear.

The girl told police in interview that once she hears of what had happened from Ali she initially “laughed it Off” as she was “embarrassed” and that it was a way of not having to deal with it.

But she said that once she “sat down and seriously thought about it, it’s a lot more serious.”

'No fit state to consent to anything'

On December 27 - Ali is alleged to have called the girl after he received a visit from police.

She also says in messages he “promised her” that he “never took advantage” and she thought he was a “genuine lad, and being a nice guy”.

She told police that she also partly “blamed herself” for getting so drunk but maintained she was “in no fit state to consent to anything”.

She 'recognised him'

She said she “recognised him” but was unsure whether that was because he took her home after the night out in Yarm or whether or not it was from a previous taxi journey.

She said that in his messages Ali “seemed so nice” but that her friends called her “naive” for thinking that.

She then became more concerned after finding bruises and scratches.

Snapchat details

In her interview the woman says that she feared she had an STI before seeking advice from NHS Direct.

After messaging Ali she says she also asked for his Facebook details to see if she recognised him.

He instead sent over his Snapchat details and sent a picture of himself to her.

She says that after hearing from Ali she “tried to find the humour” in what he was saying but soon came to realise how serious the situation sounded.

She says she then had “pain” that was a “really uncomfortable feeling”.

She then went in the bath where she found bruising and scratch marks.

Video of the woman’s police interview is now being shown to the jury.

In the interview the woman states she had drank cider, vodka and sambuca shots and woke up the next day at a relative’s home.

She says she then received a text message from a mobile number that had been saved in her phone.

He tells the jury she called NHS Direct with concerns and was then told to contact police.

On Boxing Day she went to a police station and explained what happened.

Scratches and bruising

Mr Dodds says that later that day, Ali text her saying “It would be nice to have some fun with you before you go back (to uni).”

She declined but said “thanks for the offer”.

The woman then realised she “had some scratches and bruising, and soreness in her genitalia.”

Texts exchanged

Later that day, the woman received a text from Ali asking if she was ok and that he had “dropped her off”.

He is alleged to have text her:

"You were upset about something and you touched me a few times."

The woman replied and a few messages were exchanged between the two.

At points the woman was texting him saying she was “bad laughing” at what he was saying happened the night before.

Mr Dodds says:

"The defendant suggests he saw her go into (the address he was given)"

The person who lives here has no recollection of her returning to their home.

Mr Dodds says:

"This case is about what happens in the taxi then. She remembers nothing of it."

The jury hears that the girl woke up the next morning at a relative’s property which is not the address her friend gave Ali.

The woman has no memory of how she got to this house.

Mr Dodds says that the woman “may have had too much to drink”.

CCTV footage is being shown to the jury of the girl being led out of the pub by friends and into Ali’s taxi.

Friends put her in a taxi

She had been drinking and her “friends were concerned about her conduct”, friends were having to hold the woman up.

Friends then decided to put her in a taxi. Ali was the taxi driver.

The jury is told that the woman’s friend gave an address to Ali.

He then requested she be put in the front seat “in case she was sick.”

Mr Dodds begins by telling the jury Ali is 28 years old.

The woman complainant was a teenager at the time.

She had been socialising with friends in Yarm and had been to a friend’s house before moving on to a pub.

No sign of any live updates today, but second link below seems to be summary of today's proceedings. Yesterday's proceedings seem to have been summarised in this first piece, which has a dramatic headline which I don't think was really picked up in yesterday's updates. But if you've read the stuff above then I don't think there's any need to read this first piece, apart from the headline:

A jury has heard the phone call made by a taxi driver to a woman days after he is alleged to have sexually attacked her.

Arfan Ali is accused of engaging in sexual activity with the woman, who was 19 at the time, without her consent on Christmas Eve 2017.

Ali, 28, of Marton Road, Middlesbrough, denies the charge and is standing trial at Teesside Crown Court.

On the second day of the trial, the jury heard evidence from the woman's friends, as well as hearing a recording of a phone call that Ali made to her on December 27.

The court heard that after the woman contacted police regarding her taxi ride home from a night out in Yarm, officers paid a visit to Ali - who then called the woman to ask what she'd said.

Shaun Dodds, prosecuting, heard evidence from the woman's friend, who was with her in a pub at the time when Ali called.

She recorded the phone call, and it was played to the jury on Wednesday.

During the 12 minute call, Ali insisted he "didn't do anything" and "got her home safely" that night.

"I didn't touch you or anything like that" he could be heard saying.

The woman told Ali that she had no recollection of the taxi journey, but soon questioned him about the address he dropped her off at, as well as the injuries to her body.

At one point she asked: "How the hell did I get a bruise between my legs?"

When she was put in the taxi by her friend shortly after midnight on Christmas Eve, Ali was given an address of a relative to take her to.

But she woke up confused as she was at her mum's home - which is a few streets away from where she was supposed to be dropped off.

In the call, Ali had no explanation of how she may have got to the other address.

She asked in the call: "Was I in any fit state to walk?" before adding "If you haven't done anything wrong, how the hell did I get to another address with scratches all over my body and bruises?

"If it wasn't you, then it must have been someone else and it's making me really worried."

Ali replied saying: "I've told you, I'm not like that...I got you home safe."

The woman told Ali that she contacted the police because she had no memory whatsoever of the journey and found it odd she had injuries as well as "soreness" between her legs.

She told him that he had "nothing to worry about" if he hadn't done anything wrong and that she wanted to find out what had happened to her.

"I'm going to have to find out what's happened. I think something might have happened to me, so I need to find out what", she said.

On the first day of the trial, jurors were told that the taxi driver's DNA was found on the woman's underwear.

The decision was reached on Thursday afternoon for legal reasons.

Ali, of Marton Road, Middlesbrough, was bailed until a fresh trial on a date to be fixed.

Possibly.

When witnesses give evidence they are told not to discuss anything they have said or heard in the trial until proceedings have finished.

Detailing the process, as we saw above, could be read by those yet to give evidence, and that could cause difficulties for the court.

Might be something else that has caused the trail to collapse, but it's horrible for witnesses that have already given evidence as they have to give that evidence again, :sad: :sad: :sad:

But in that respect I can't see how the live updates differ from a report in the evening paper, or in next morning's, say.

The basic contempt of court rules in this regard are, as I recall them, that factual press reports of the court's proceedings are entirely legitimate, and indeed we take such things for granted when it's a high profile case.

So only real difference I can see here is that live updates must be very difficult for a reporter to accomplish with absolute accuracy, so to that degree there's more of a possibility that they might fall foul of the contempt of court rules.

But the relevant page in this case is certainly still online, but whether any amendments may have been made to the page obviously can't be known without sitting down and going through every word [-X

So suspect it's something else, but presumably we'll be told the precise reasons in due course?

I did check that, and that in itself indicates the article was not to blame.

But the point about live evidence being reported is extremely valid.

No doubt we will be told when the matters are finally concluded.

Taxi driver accused of sex attack on 'very drunk' teenager after picking her up in Yarm

A taxi driver has gone on trial accused of sexually assaulting a "very drunk" teenager.

Arfan Ali, 30, took advantage of the "very vulnerable" alleged victim without her consent after picking her up in Yarm on Christmas Eve in 2017, the prosecution claims.

The woman, who was 19 at the time, had been socialising with friends when she was put in a taxi, driven by Ali, to be taken home.

She couldn't recall the journey but contacted the police after discovering bruising on her body.

Paul Cleasby told jurors at Teesside Crown Court on Wednesday: "The prosecution case, ladies and gentlemen, is that this defendant, as a taxi driver was in a position of trust, he had one job that night in relation to (the victim) to take her home and deliver her there safely."

Forensic analysis found evidence of Ali's DNA on the woman's clothing, including her underwear, the court heard.

The alleged victim's police interview explained how she had been out drinking in Yarm and "after them drinks I can't remember anything, it's just blank."

She said the defendant texted her the following day saying "hi, how are you feeling this morning".

"He said something like 'you touched me a couple of times.'"

The woman said she was initially "mortified" and "tried to find the humour in it".

But she later discovered bruising on her legs and scratch marks on her body, and went to the police.

The teenager told officers how Ali rang her "wondering what's happening" after he learned the police were involved, a call her friend recorded.

Ali, of Marton Road, Middlesbrough, denies engaging in sexual activity without her consent.

The woman, who was 19 at the time, had been socialising with friends when she was put in a taxi, driven by Ali, 30, to be taken home.

She couldn't recall the journey but contacted the police after discovering bruising on her body.

Ali, of Marton Road, Middlesbrough, is currently facing a trial at Teesside Crown Court and denies engaging in sexual activity without her consent.

On Thursday, the jury heard evidence from the alleged victim, who said she has "no recollection" of the night and said she was "unsure" as to whether one of her drinks may have been spiked while out.

The jury heard that the woman had consumed "pre-drinks" before heading out at around 10pm and "ended up in a nightclub".

The woman said she could not remember getting home and was "unsure" about whether her drink had been spiked.

The jury heard that she received a text message from Ali the next day at around 1pm and that they exchanged messages.

The woman told the jury that she was "embarrassed and mortified" after Ali told her she had "touched" him a "couple of times".

Among the messages that were sent, the jury heard the woman sent a "laughing emoji" and "LMFAO" to Ali during the conversation.

When asked about the messages, she said: "I didn't realise what had actually happened to me.

"At the time I didn't know. The taxi driver said I touched him. I was asking these questions as I didn't have any recollection."

She was also asked why she asked if Ali had Facebook.

"I wanted to know who this person was and who was texting me", she said.

The jury was also shown CCTV footage of the woman's friends leading her to a waiting taxi.

Giving evidence, one friend said she asked for her address and relayed that to the driver.

The next day, the alleged victim Facetimed the same friend and later said she was "panicking about what she'd done" after a "taxi driver texted her".

Well this is very interesting, but very frustrating at the same time. Judge has directed jury to return not guilty verdict, but no reason given, or at least it's not reported below, which is largely just a rehash.

Nothing about why original trial abandoned either, but the judge's direction today may well be related to that in some way.

The woman, who was 19 at the time, had been socialising with friends when she was put in a taxi, driven by Ali, to be taken home.

She couldn't recall the journey but contacted the police after discovering bruising and scratches on her body.

Ali's DNA was found in the woman's underwear and on her clothing, the court heard.

On Thursday, the jury heard evidence from the alleged victim, who said she had "no recollection" of the night and said she was "unsure" as to whether one of her drinks may have been spiked while out.

The jury heard that she received a text message from Ali the next day at around 1pm and that they exchanged messages.
