Winsford taxi driver arrested on suspicion of drink-driving A FEMALE taxi driver on her way to do a school run has been arrested on suspicion of drink-driving. A police officer spotted a car driving erratically in Winsford at around 8.50am on Thursday, December 14. Posting on social media, a Winsford Police spokesman said: “A police officer on the way to work noticed a white Kia hitting kerbs and being driven at approximately 10mph. “It was noted that the Kia was displaying taxi registration places.” The officer called 999 to report concerns about the manner of the driving and followed the vehicle until it came to a stop outside a house in Winsford. When further officers arrived, they breathalysed the driver who was found to be almost four times the legal limit at the roadside. “Uniformed officers arrived and conducted a roadside breath test with the female driver, who subsequently blew 130 at the roadside," the post continued. “The legal limit being 35. “She was arrested and we gave her a free lift to Middlewich custody.” The woman has since been charged and will appear at Crewe Magistrates Court on January 11 next year. |

Absolute madness. Going to lose her job and her livelihood, and for that reading the starting point is 12 weeks in custody. https://www.sentencingcouncil.org.uk/of ... ised-2017/ |

To have that reading at that time of the day she would have been drinking all night, and soon before she set out. Very sad.

Looks like she's lucky to avoid jail here, although I'm sure Sussex will know the full SP. But looks like she's just into the worst tier in terms of the breath test (123 μg while the top tier starts at 120 μg - presumably the 123mg stated below is the same thing...), which might be why she's avoided jail. And which might also explain the odd 29 months disqualification figure. That's the starting point for disqualification at that level of alcohol, according to the Sentencing Council document linked to by Sussex Doubt she'll get her badge back in a hurry, though Drunk taxi driver caught by police on way to take child to school avoids jail https://www.cheshire-live.co.uk/news/ch ... e-28435726 Lacramioara Giurgea, who kept hitting the kerb, was more than three times over the legal limit A taxi driver responsible for transporting children to school has avoided jail after being caught drink driving. Lacramioara Giurgea, of Stirling Close, Winsford, was handed a suspended sentence when she appeared at Crewe Magistrates Court on Thursday (January 11). At around 8.50am on December 14 last year, an off-duty police officer began following a white Kia driving erratically in the Dalefords Lane area. The car was travelling at around 10mph and repeatedly hitting the kerb. Officers were sent to the scene and the car was located on Peach Way. They were greeted by 46-year-old Giurgea behind the wheel, and discovered that she was a taxi driver about to collect a young child to take to school. She smelt strongly of alcohol and was arrested at the scene after failing a breath test. When tested in custody, she gave a reading of 123mg per 100ml of breath - more than three times the legal limit. Giurgea was sentenced to eight weeks in prison, suspended for 18 months, having pleaded guilty to drink driving at an earlier hearing, and was also banned from driving for 29 months. Inspector Jason Murray said: "Giurgea was more than three times over the limit and was in no fit state to be behind the wheel, let alone drive a child to school. "Thankfully, as a result of the off-duty officer who reported her driving, we were able to arrest her and quickly bring her to justice – thanks to them it is highly possible that a serious collision was avoided. "If you have any information about people who drink alcohol and then think it's acceptable to get behind the wheel, please give us a call. Your actions could save a life." |

Quote: Looks like she's lucky to avoid jail here, although I'm sure Sussex will know the full SP. I think the court got it right. The starting point is 12 weeks; she got a third off for pleading guilty. Although given the facts we have seen so far she had little choice. So the next issue for the court was immediate custody, or a SSO (suspended sentence order). It doesn't say but I suspect she has also got unpaid work and/or an alcohol treatment program. If she had been given immediate custody she would have done 4 weeks inside, and the rest on license. |
