Haven't really been paying attention to this, but thankfully PHTM have done an article on this.

Should have been implemented immediately and include proprietors.

HMRC have just published a Policy Paper in respect of the new law that will apply after April 2022.

Interesting that it only applies to England and Wales in the meantime, but will be extended to Scotland and NI in 2023.

Because taxation stuff is still the responsibility of Westminster, I assumed it would apply equally throughout the UK. But I'm guessing the reason is that it will require changes to the devolved licensing legislation, so that's the domain of the Scottish Parliament and NI Assembly (I thought Wales was the same in that regard, but maybe not).

I hope that this will also extend to the use of escorts on school contracts. i am fed up with trying to compete with people who pay their escorts in cash at around £4-5 per hour. Also if this is for drivers badges and operators licenses then the 2022 date could be useless. If a driver has his badge renewal in march 2022 then he doesn't have another renewal until march 2025 and an operator renewing in March 2022 has 5 years before the next renewal.

Well it’s got to start at some date, and in time it will effect all license holders.

In respect of school escorts they aren’t licensed, so it’s not for them.

But isn’t there a low pay unit that deals with folks being paid less than the minimum wage?

Escorts here are badged by the County Council.
I think the low pay unit deal with complaints from people who are on the low pay. If you are working for a few quid cash in hand and claiming benefits you are not going to complain.

I think they provide a badge more for identification purposes. You can't be an escort without having an enhanced DBS check and they issue to badge to people who have had the check.

Sounds like they wouldn't be able to apply the tax registration test to issue these badges, then - the list specified by HMG seems confined simply to HC/PHV drivers and PH operators (but oddly not plateholders, as far as I can see). And, of course, the scrap metal dealers.

I put a post on here about 2 years ago.
Saying that all drivers including uber and private hire and Hackneys you should be registered self employed or have a paye number before the council issues you with a licence. And it didn't go down to well with some drivers on this forum i could tell by the reply posts i received.

Logically when you look at it, councils could start to implement it now on a voluntary basis, from now up to the date that it has to be implemented only issue, yearly licenses unless you Can provide the relative paperwork from the taxman and then you can have a three-year license

County say ours must be PAYE but dont enforce and wont say if its for a whole trip or just while kids are onboard
