The Sherrif in the most recent Dundee case stated that a council must address the issue of unmet demand "as of now" meaning, when the application is first recieved. The extract from the transcript is as follows.

"The sheriff held, under reference to the decision in Coyle v. The City of Glasgow District Council 1998 S.L.T. 453, that the committee's assessment under section 10(3) of the Act had to be made in relation to the situation at the time when the application fell to be considered".

I was browsing my files today and came across a reference from the Rushmoor case back in 1986. the judge ruled "it was of now" and not when the appeal against the refusal was lodged.

If anyone has the 1986 Rushmoor BC case could they please post it.

why would you want it?

I don't think Mr T was born when the Rushmoor case came about. If you have the case I suspect you can tell me who the apellant was?

Yes It was ABC Cabs of Camberly LTD it was 1976

Whilst its rude to guess a persons age, I think mr T is over 29?

may Mr T forgive me

I am tired JD, working long hours and apt at making clumbsy mistakes please forgive me

it was Mc Cool v Rushcliffe Borogh Council Appeals heresay admissable even if from criminal aquitals.

Seems like we have a gremlin in the works. First you post as MR T at 1.27 am, then you quickly delete that post and immediately post as Harold Best, I wonder what conclusions we can be draw from that?

In answer to your first post when you donned your MR T persona, the question I posed was about Rushmoor not Rushcliffe. You asked if it was Mc Cool v Rushcliffe. I said Rushmoor 1986 not Rushcliffe 1998. I suspect that answers the question to your second post when you posted as Mr Best. Perhaps you better stick to your familiar roll of representive of the North West Taxi association, instead of trying to play mata hari. You are too transparent Mr Smith & Jones. Or is that Jekyl and Hyde?

I'm just wondering what other characters you play besides the ones I've mentioned?

No never have been a representative of North West Taxis, mores the pity, try Jeckle and Hyde.

Neither have I ever posted as Mr T, WOULDNT DARE! one can fear a proper taxi man who knows what he is doing.

yes I have made mistakes tonight, but doing as you claimed wasnt part of it.
