Its okay guys I am not trying to start a war, just a question.

As an independent hackney in Cardiff our tariff only allows us to charge £1 per person over four passengers off the streets for journeys within the boundaries. Would I be right in saying that a hackney 6/7 seater driving for a private hire firm could legally charge shall we say a fare and a half within the city boundaries, if that what was quoted prior to the journey starting.

Why not ask the council to amend the tariff sheet so that you have 2 tariffs, one for 1 to 4 and fare and a half for 5 to 7, have a look at the post traffic commissioners report to see how ours works, then when you go outwith the boundaries just keep the meter running

I suppose it all depends on how much work a radio will give you, especially 5/6/7 seater work.

If there is loads about, or you think you can gain a bit via advertisement, then go for it. Otherwise stay as you are and hope all 5/6/7 seater work is going out of town. :wink:

Not even Misc. prov. act 1976, section 67?

(1) No hackney carriage shall be used in the district under a contract or purported contract for private hire except at a rate of fares or charges not greater than that fixed by the bylaws...

A hackney carriage is a hackney carriage no matter where he is or works.

A hackney carriage doing private hire work outside of his manor is still a hackney carriage. :wink:

So if I rang a private hire office and asked for a 5/6/7 seater and they then quoted me fare and a half, then it would be alright to charge that if they sent a private hire vehicle even though it has got a meter installed - but they could not if it were a 5/6/7 seater hackney.

Sorry if I have got this wrong but I need it clarified.

Our conditions state that "It is not obligatory for a fare meter to be fitted to a private hire vehicle,but any private hire vehicle so equipped shall not be used for hire in a controlled district unless the fare meter has been tested and approved by the council."

I thought you said a hackney carriage "could charge more" than the metered fare and my response was no it can't. I didn't see your your "NO" before "MORE".

There is two ways of reading the section in the act relating to PH meters.

One is that the council seal and confirm what rate is on the meter, and the other is that council can merely just approve the make of meter allowed.

I think it's the latter and councils should have nothing to do with what goes on or in the meter.

If it's the former then the council will have to have umpteen different rates to check and enforce. Including different yardage, different night-time starts, extras, meter and a half etc etc.
