And I know where you are coming from but considering the court were not posed with the question of whether or not a badge should be worn at all times then it is hardly surprising they didn't mention it.

My own opinion is that the question of displaying a badge is catered for in the conditions set by each individual licensing authority and as I have pointed out, the nearest we have come to addressing that situation is by way of the Hussain case.

I don't know the answer to the question and that is why I only offer an opinion. I believe under the circumstances that is all any of us can do until such time it is resolved.

The above aside, there seems to be a growing number of LA's trying to 'do' out of town HC's for displaying for hire lights.

I even heard of one LA trying to 'do' one of its own cars for not displaying a roofsign in another area.

The way I read all the acts and judgement is;

You need to be a HC/PH driver to drive a HC/PH.

A HC/PH is always a HC/PH.

Therefore a HC/PH driver, IMO, should always have to adhere to his conditions/bylaws if they say a badge must be worn, even if he isn't working.

I think my byelaws say the badge must be either worn or displayed.

Carlisle licensing department just told me you don't have to wear your badge when you are not plying for hire and driving for pleasure.

Considering you are licensed by them I think it might be prudent to get them to clarify the situation in order to put your mind at ease.

well when i go on holiday, the signs, plates and badges stay at home, i dont want skegness LO's having me for touting....

When I go I leave everything in place, and the looks on some of the drivers faces is priceless, and you can sense they are thinking how the hell did he get a hire like that :D

Found them, quaint old things.

9, If a badge has been provided by the council and delivered to the driver of a hackney carriage, either with the licence granted by the council or afterwards, he shall, when standing, plying or driving for hire, wear that badge in such position and manner as to be plainly and distinctly visable.

Great news indeed.

Mind you, byelaw 11 is a tad dubious;

Every proprietor or driver of a hackney carriage who shall knowingly convey in the carriage the dead body of any person shall, immediatly thereafter, notify the fact to the sanitary inspector of the council.

You don't need a licence to convey the dead. Only the living are fare paying passengers.
A corpse counts as "goods in transit" :shock:
