Well as of yesterday there is no sign of any judicial review and I have just taken deliver of my new cab and FREE plate. :D :D :D :D :D :D :D

Well congratulations, I suppose this thread is now a dead duck assuming the Chester lads have backed out of a judicial review? I suggest it was a wise move on their part but they still have a few weeks left to get their act together.

I suspect they have other things on their minds at the moment as there is an argument ongoing about the Railway Station at the moment.

It seems that during the renovation around the station earlier this year the Hackney rank was moved and is now officially adopted by the highways dept and as such is an official licensed rank of Chester City Council and as such open to anyone with a hackney plate. Historically the rank has only been used by cabs obtaining a permit through the Chester Taxi Association who were under the impression that they had sole access rights.

Basically as I am not a member of the Association and have no permit I was told I could not pick up there by association members who were apparently unaware of the status of the rank and as such have been paying for permits.

The rank used to be on station property but was moved during the regeneration. They have been officially informed by the Council today but whether they accept it is another matter.
However I have been told again by the Council that I am entitled as the Licensed Proprietor of a Hackney Carriage to use the rank regardless of what anyone else says.
I did pull on the rank last night and was asked to leave so I agreed that when I got a passenger I would leave and not return until today when the situation could be confirmed.
I have been told today that everyone else had been informed and the status of the rank should now not be in dispute.

Well at least its now sorted out. If you get any trouble remind them of Section 64 TPCA 1847.

section 64 Penalty on drivers obstructing other drivers.

Any driver of any hackney carriage who suffers the same to stand for hire across any street or alongside of any other hackney carriage, or who refuses to give way, if he conveniently can, to any other carriage, or who obstructs or hinders the driver of any other carriage in taking up or setting down any person into or from such other carriage, or who wrongfully in a forcible manner prevents or endeavours to prevent the driver of any other hackney carriage from being hired, shall be liable to a penalty not exceeding [level 1 on the standard scale]

I'm glad you clarified this, I was going to call the Council and ask what the situation was.
Two different ppl told me not to bother buying a black cab "'cos they wont let you on the station rank".
Nice cab by the way.
