Well I pulled on the station rank again last night and again was told that without a permit I was not allowed to pick up there.

So again today I phoned the council who told me that it is indeed adopted by Cheshire County Council and as such is a Licensed Chester Rank giving me the right to use it, however he did say that they were waiting for the County Council to confirm this in writing to the Association and in the meantime it may be better if I avoided it so as not to cause any animosity. I have agreed to this as a temporary measure however if I drive past and see people waiting then I will stop and pick them up.

Right now I feel like the piggy in the middle. I was also told that the association had been paying for the rank since 1982 when they didn`t have to, so I can see that they must themselves be a bit p***ed off to say the least.

The worst thing is that if you speak to different people in the council then you get different answers !!!!

The short and simple answer is this. If the Taxi rank is not on station property then you are entitled to use it. If any driver tries to stop you from using it then take their number and report them to the council. I would phone up the station if I were you and ask them do they own the land where the taxi rank is situated. Better still drive up there and get it in writing also get it in writing from the council because waiting for the county council to get their act together could take weeks. How is the Taxi stand sign worded? Does it just say stand for x amount of cabs?

I have asked the council for something in writing but as yet nothing is forecoming, the Council say they own the land, the station say they might but still want paying the association say they won`t allow anyone without a permit to use it until the station are told they cannot charge. Its a merry go round at the moment.
As for signs I will double check tonight and have a look.

The other way is to use the Internet & log on to the Ordinance Survey site to search out the OS map of the immediate area/location to see if there is a boundary line on that map.

There is a charge for this service, but you can print off a copy of the OS map. I think you also need the exact Post Code for the location.

In Brum at New Street Station, there is a physical boundary in the road in the shape of a drainage channel, running the width of the roadway to distinguish the station road & the council road.

Also, have a look at the road surfaces to see if there is a distinct difference in upkeep from one area to another, & also the road markings in the gutter.

Have a look at the double/single yellow lines & especially the return lines on these. If there are two return lines next to each other on the yellow lines, you can bet that is where the boundary might be.

Since the area was regenerated it is classed as a heritage site so there are no road markings at all and very few signs.

Its not me who they want paying by its the Chester Taxi Association of which I am not a member.

I have just heard a rumour that the Chester Taxi Association has in fact this afternoon got an injunction or stay on the issueing of any new plates. I have not got any details as yet but there are at least 2 drivers who have ordered cabs and now cannot get plates.

What a mess, just glad I hadn't got to the ordering stage.
Anyone have any idea how long this will all take if they have indeed got an injunction??

The injunction, if agreed at a full hearing, will last up until the judicial review. But someone needs to contest the application.

If I had ordered a WAV and the injunction had stopped me licensing it then a claim against those applying for the injunction would be made once they lose their judicial review.

But I can tell you now that even if the existing trade win any judicial review, it will mean jack s*** cos the council will just review/consult and do the same thing again.
