Perhaps the judge might look at the wording of Section 16 of The Transport Act 1985 & think it might have some relevance in this case;

....... that the grant of a licence may be refused, for the purpose of limiting the number of hackney carriages in respect of which licences are granted, if, but only if, the person authorised to grant licences is satisfied that there is no significant demand for the services of hackney carriages (within the area to which the licence would apply) which is unmet.

Could the judge use this wording, in 'reverse' as it were, to say that Berwick Council should have been satisfied that there was no significant demand within the area to which the licence would apply, which was unmet, & therefore should have stopped issuing licences?

I hope he does because the consequences could be 'manna from heaven'.

Well I don't know about parliaments wish but I sincerely hope someone can show me just exactly where parliament have said it is their wish but the point Maddox has failed to grasp is that these vehicles are operating under a contract of private hire and not hackney carriage plying for public hire.

We have two top Barristers who have both shown themselves to be rather inept when it comes to the nuts and bolts of the circumstances surrounding the activity of these drivers.

I can here the moans of the judge from here.

Thats very true.

When a council issue a license they issue it to a criteria....provided the applicant fulfils the criteria a council cannot refuse to issue a license.

I'd like to see the Newcastle case, no doubt we will in due course, I wonder how the case was accepted as sufficient enough to warrant a Judicial Review, but without seeing it I'm making wild stabs in the dark.

If Newcastle win....I'd be very surprised nevertheless (I say that every time they play too :lol: ).
