Taxi driver accused of Moulsecoomb rape


A terrified student was raped by a taxi driver when she could not pay her fare, a jury was told.

The 19-year-old was forced to have sex in the back seat of the cab because she did not have £2 to pay for the journey home in the early hours of the morning, it is alleged.

On trial at Lewes Crown Court, taxi driver Abul Malik, 29, denies raping her.

The court heard the driver, who is licensed by Brighton and Hove City Council, claims the girl consented to have sex.

Oliver Dunkin, prosecuting, told the jury the alleged victim had gone out clubbing in Brighton on the night of June 17 with other students from the University of Brighton.

She was “tipsy” when she and two male friends got a taxi home in the early hours of the morning.

She wanted to return to the halls of residence at Falmer where she was living while the two men wanted to be dropped off at Newmarket Road. They knew she had no money but when they reached Newmarket Road they left the cab after only paying part of the fare claiming they had no money to pay the rest.

She was left alone with the driver who was angry and demanded the full payment of the £6.80 fare. Her friends had paid less than £5 of the cost.

While one of her friends went to a cash machine to get some money, the alleged victim rang 999 because she was scared as the driver refused to let her go.

He had demanded she hand over her shoes as security for the payment when she offered to pay the following day.

But the 999 operator told the student the emergency services did not operate a taxi service and suggested she walk back.

Mr Dunkin said when she started walking, the cab followed her and the driver offered to take her home. She reluctantly agreed because she was not sure how to get home. However, on the way she realised he was not going in the right direction.

He drove her to Jevington Drive, in Moulsecoomb, which backs on to a wooded area.

Mr Dunkin said: “He told her she could pay the fare another way.”

At first she refused but when he allegedly threatened to leave her there she started to cry.

Mr Dunkin said: “She was very frightened.

“She was crying and begging to be taken back to Falmer.”

He said sex took place on the back seat and she did not struggle because she was terrified.

He said she had submitted to what happened but had not consented.

Afterwards, he took her back to the halls of residence where she told friends what had happened and the police were called.

Malik, of Trafalgar Road, Portslade, denies two charges of rape and one offence of sexual assault. The trial continues.

I don't know.....I cant see the person who was raped actually questioning the person or having any opinion other than the driver was supposed to have been vetted and shouldn't have committed the crime.

Presumably wannabee thinks true Brits don't rape people?
