Last saturday night we had the usual Peterborugh PH cars trying to rank up in the square where the taxi rank USED to be. Absolutelt no danger of them getting caught as the council does not employ a full time enforcement officer !

One of the local hackney drivers who wasn't working but out for a drink walked up to him

Hackney driver " Are you free mate"

PH driver "yes where do yyou want to go"

Hackney driver " Cliff road "

PH driver " you show me the way ? "

Hackney driver " OK mate"

Actually he only lived 5 minutes walk up the road but the PH driver thought he had a fare

3 minutes later they are at the house the local hackney driver gets out and says " I'm not paying you your a PH illegally ranking ! "

PH driver " No you pay me or I'll call the police ! "

Hackney driver " Yes lets call the police and I can explain to them that your a PH from outside the area illegally plying for hire ! "

the PH driver drives off the local Hackney driver got a free lift home RESULT !!!!! :D :D :D :D :D

i was considering organising something similar in London; a group of us getting into illegal PH's outside one of the clubs in Kensington/City etc and having the muppet drive us somewhere. Once at the pre-determined destination, perhaps near an open police station, getting out and refusing to pay..............on second thoughts, where the hell do you find an open nick at night ??

Ah well, it was a thought anyhow.

GD, read it again

Quote:
Hackney driver " Yes lets call the police and I can explain to them that your a PH from outside the area illegally plying for hire ! "

but as i said, if it had been a HC from outside the area then that would also have been an offence, once out of its own LA a HC only has PH status (i.e. jobs should be pre-booked, no flag downs, no touting) - a Bradford HC TX2 plated for HC in Bradford cannot take a flag down in York can he.....

personally i see the greatest threat as being not PHV, but non-local taxis, punters seeing any old LTi or metrocab or E7 (whatever) with a "taxi" rooflight as being a locally plated vehicle (few have plates on the sides or front), so they all look alike to joe public...

The law provides general powers that allow any person to make a citizen's arrest under certain circumstances - including if they witness an arrestable offence. However, there are many legal issues which make it a complex matter with many grey areas.

The current powers of citizens' arrest, that apply to "any person", are broadly covered by three parts of the law.

• Arrest for an "indictable offence" under the Police and Criminal Evidence Act 1984.
• Arrest of persons committing, or about to commit a Breach of the Peace under common law.
• Use of reasonable force to prevent crime or arrest offenders or persons unlawfully at large under the Criminal Law Act 1967.
