They where not forced to do anything they where advised and they are free to stick 2 fingers up to the ruling, and appeal against the costs.
if they refuse licence and the applicant is fit and proper they will be breaking the law
a quick trip to the magistrate will sort it out

The judge in this case was like a headless chicken and did not have a clue

Skippy

You could well be proved, especially given the quantum leap in medicine, at some point fit and proper.

However, if you apply for a hackney carriage license in Carlisle for a saloon car, you will be refused.....but not on the basis your not fit and proper....on the basis they no longer issue new licenses to saloon cars.

if I wanted to put a saloon on in Carlisle I would do so through the court if need be, but as they already licence saloons there should not be to much trouble getting one on

Skippy.... I don't really think you understand what a judicial review is.... you might well be advised to ask JD to explain.

Judicial review

The High Court can review decisions of inferior (lower) courts, public bodies and other bodies to ensure that the decision making process has been lawful

All this judgement has shown is that the law as it stands is an ass.
This needs to be sorted out properly ASAP.

Adopt the Scottish 1982 act :?: or rewrite the rules altogether, I would say around 80% of the rules and laws are out of date.
