ok

answer me this then

when im working my vehicle i need to wear my badge

when im using it for family use i dont

so then, whose to know im badged when i pull up with the wife at sainsburys, cos if a coppper asks to my badge then ill tell him to naff off

Quote:
i) Wear the badge provided by the Council so as to be clearly visible to the hirer

she wont be hiring me, so there

Why would you tell a copper to naff off? Here we have two badges one is the one that goes around my neck when I'm working (my shackle) the other has to be displayed in the vehicle permantly so if the copper wanted to see my badge he could in fact anybody can I have nothing to hide. If they wanted to see my documents they could no problem I'm all legal so no worries. I have friends who are badged and have fully comp insurance same as I do but they can't drive my taxi unless I name them on the policy and pay extra for the priviledge. I'd certainly confirm who is entitled to drive any vehicle I had before I let them it just seems better to be safe than sorry :)

clever copper sees me at asda dropping wife off, no badge in view

clever copper (cabbie or LO in the family) thinks "ill nab him"

clever copper tells me im committing and offence against some regs which should have died with Nelson by not having badge on view to hirer (he doesnt know the wife hasnt hired me)

he can check insurance, test (a proper MOT), and my DVLA licence with a simple radio call to his control room

And of course because you have decided not to be helpful, whilst he is waiting for the reply to his inquiry he may just give your vehicle the once over and who knows he may find something wrong that could get you a fine and points.

i wouldnt be UNHELPFUL but simply concise, no i dont have my badge on view. end of.

Hi all,

I'm about to embark on the road to become a Private Hire driver in Dorset. I'll have loads of questions before I get the licence, i'm sure, but for now, Weymouth and Portland BC say in their "booklet" that only the person registered and licensed can drive the car. That's gonna annoy the wife! Surley the wife is ok for SD+P?

The definition of a private hire vehicle in s. 80(1) of the 1976 Act refers to its characteristic and not its present use. It therefore applies to all driving of a licensed private hire vehicle within a controlled area regardless of whether it is being used for the purpose of hire or reward or domestic and pleasure.

It doesn't make any difference whether it is inside or outside its licensing authority the characteristic of the vehicle never changes, in other words as long as the vehicle is licensed as a private hire vehicle then that is how it shall remain until such time it is not licensed.

The area that licenses you, not the area that you are only licensed to work in.

That's as maybe but I think you may find it is national if it isn't international. As I said earlier a simple check with your insurance company will tell you if your wife is able to drive your licenced vehicle without a badge.

Controlled district' means "any" area for which Pt II of the LGMPA (as amended) is in force by virtue of:

(1) a resolution passed by a district council under s 45; or (2) the Greater London Authority Act 1999 s 255(4): Local Government (Miscellaneous Provisions) Act 1976 s 80(1) (amended by the Greater London Authority Act 1999 (Hackney Carriages and Private Hire Vehicles) (Transitional and Consequential Provisions) Order 2000, SI 2000/412, art 7(3)).
