I see your comments regarding the above company that operates across 4 licensing areas.

I understand that finally the licensing team where their offices are have finally got their backsides into gear and they starting proceedings against them. The company at the moment is licensed by Reigate & Banstead, Wealden, Mid Sussex and Mole Valley, they continue to accept bookings in Reigate & Banstead and dispatch these bookings to vehicles and drivers licensed by another district.

The continued communication with licensing team as come to fruition and we finally see some action taking place........

Interesting comments Mr pfoster.

Wealden, bless them, have licensed over 30 PH operators not based in Wealden. But I think they might be following Lewes' new guidance, based on case law, that they can't do that anymore.

But if anyone doubts the legality, or ill-legality, of all this cross-border PH passing work, they need look no further than the proposals from some of the 'Meeting of Minds' mob i.e. NALEO and the NPHA who want to make what the named firms are doing legal.

Now the fact that they want to make it legal should indicate that it's presently not.

Well cross border hiring has certainly come to prominence again but this time it appears to centre on those people who see themselves more as an agency for all and sundry rather than a private hire operator.

I think this hits the nail on the head, any private hire operator should be able to accept a booking at their premises/phone/internet and pass that booking via another operator in another area but not directly to a car/driver that is not licensed in the same district.

My own operation is 1427 yards from an adjoining boundary and because of the natural geography of the land 99% of journeys mean crossing into the other district. I also have SIX other licensing authority area's within a 10 mile radius of my operating centre. So the cross border debate is far more important in some area's than others who's only border is the SEA.

Agencies who do not have any operator licence in any area should be barred.
