What's this bit about and why should it make a difference?

Why should HC be treated any different than PH when it comes to disqualification ?

It's mitigation, and like most crimes there are different levels. What a defence brief will say is that no taxi driver lost out as their were none available. And it's better the person got home in an un-licensed vehicle than drove his own vehicle pi**ed up. :?
