i had a bang back in april on a busy city centre roundabout. i was in the inside lane and someone came out and hit me in the left, rear passenger door. simple case of them not looking and not my fault, or so you would have thought.

i was sent a copy of the other persons verison of what happened. and basically it was a total work of fiction. they where trying to say that they were already on the roundabout and i was in the outside lane and cut across them for the exit. also saying that i was speeding etc..

i was livied when i read their account, as up to that point i had NEVER had an accident in 15 years of driving and my one and only speeding find was from when i was 18. i consider myself to be a safe and courtious driver with good knowledge of the local roads and what they said in their account of the acident i took as a personal insult and not just a lie to defraud their insurance company.

i'm willing to go to court over this as i know im in the right but dont know how to go about evidence, as it is basically its my word against theirs. no witnesses.

the garage who did the repairs took photos so maybe that could prove that i was hit from the side, rather than me scraping across the front of someone else at speed.

Also i have noticed that there are a couple of CCTV's covering the roundabout. does anyone know if i would be able to get footage to present to the court. even just one single still would prove where we both were on the roundabout and show the other driving to be lying (and of course trying to defraud their insurance company).

would i be able to get anything from the CCTV's? or would it need a court order?

since this i now always carry a throw away camera in the car, so if i ever have a bang again at least i can produce photos as evidence, but a bit late now.

anyone any ideas on this one?

What have your insurance company said? Surely they must be on your side? :roll:

But if they don't proceed, or just say it's knock for knock, then your best avenue is the small claims court. It will cost you about £50, but the person who lied on their claims form, will then have to lie before a judge. :shock:

And despite what we think about judges, they know when someone is lying to them. :wink:

My insurance company have been crap. i rang them on the day of the accident and all they did was to give me telephone numbers to ring. i had to find my own garage to do the work. i had to ring around different companies for loss of earnings i even had to sort my own replacement car while the work was being done.

the bang was back in april and the letter i got of them last friday was the first paper contact about the incident since it happened. imy policy is due for renewal soon but i dont think i'll be going back to them again.

i'm with Chaucer insurance by the way.

When it comes to dealing with insurance companies you have just got to keep ringing them up, and when they say everything is fine, then you ring them up again until you say its fine.

Oh, and rule number one is you always have a witness. :wink:

Carry a digital camera, I do.

Fuji finepix, A120 is about £100 and they take great snaps.(20 good quality)

Its £100 that's well worth it if your motor gets banged up.

there are dozens of companies who provide legal help a replacement taxi, and fix up your taxi no win no fee, they fall over themselves to get to you.

always always after a bang visit accident and emergency at the hospital, the reccord is invaluable, but always be cautious of over exadurating

one of my dear colleagues did just this and one day he suffered a bad injury and his payout was heavily reduced because of his over zealous claims of the past.

it pays to be honest.

I have had a this happen to me a couple of times both times the other driver has made up a totally different version of events. Also both times I had witness in my car and it made no difference. On both occasions my insurance said it would not be worth fighting in court and it went 50/50.

The insurance company have worked out it's best if they settle the claim, rather than fight it in court, and it f***ing stinks.

I would report them to the insurance ombudsman each and every time. And if that fails, then take the other party to the small claims court.

And if that fails, then a pot of paint stripper on the other party's motor.

There was me thinking, because I objected to the gypsies ripping me off, for the "building" work they did on our house, that that was the reason I had all those problems with the insurance when all my cars got hit up the back.

Must have just been paranoid.

Insurance is a rip off, it just appears to me that they delay things as much as possible, and they are all as bad as each other, they just do not want to pay out to each other, and us the poor punter stuck in the middle just have to put up with the b*****ks, why all we are trying to do is earn an honest living. I recently had two of mine off the road whilst they decided if it was my drivers fault or not he got hit up the back on the M25. God save us.

I will come out when I have earn't your confidence, don't want to be embarrassed until I have worked out how to put one of those emotions in.
