As a result of the following Employment Tribunal :Case No 2409542/07
Manchester Council will hold public consultations from July 9 next. They will vote to de-Limit on December 2 next.
The tribunal found the council's waiting list criterea discriminating as it disadvantaged Women and Asian's from obtaining free plates.
Matter are worse because several of the men of the cab trade comittee who evolved this criterea obtained free plates. Some of these were then sold on, mostly to Asians.
The Asian community in Manchester are up in arms. Meetings have been held, court action is envisaged. Who can blame them.
This action has been two years in the pipeline so it is believed to have been one of the reasons behind the Salford and Stockport decisions, both these council's are members with Manchester in the "Association of Greater Manchester Authorities"
The Equality and Human Rights Commission are belived to be involved.

I happen to believe the tribunal has a point, and I also happen to believe the way Manchester issue 'free' plates is a mess.

This recent report indicates that Manchester has two waiting lists, one you can maybe get on, and one you can't.

It would seem that legal advice is saying delimitation is an option to get out of this mess.

Self-employed

If you are self-employed you do not have a contract of employment with an employer. You are more likely to be contracted to provide services over a certain period of time for a fee and be in business in your own right. You will also pay your own tax and National Insurance contributions (NIC).

You do not have employment rights as such if you are self-employed. You are your own boss and can therefore decide, for example, how much to charge for your work and how much holiday to give yourself. However, you do have some legal protection.

For example, you mustn't be discriminated against and you are entitled to a safe and healthy working environment on your client's premises. Self-employed women who have recently left their jobs may be entitled to Maternity Allowance.

It is possible, in some limited cases, to be self-employed for tax purposes but classified as a 'worker' or an 'employee' for employment rights purposes.

They are being discriminated by not being allowed on the list that plates are being issued from. But numbers/percentages are the issue that could have swayed the tribunal.

If the Asian % of the trade is 50% (don't know exactly, just a guess), and the % of free plates issued went to 90% white folks, then that's classed as indirect discrimination.
