A year or two back the same thing happened in one of my vehicles..A TX1... but we had the whole thing on CCTV... a young child ended up with a broken nose.... the duty of care regarding the child is with the parent..... especially in a petition vehicle.... if the driver has to make a sharp stop or even break sharply to avoid a serious accident, he is acting correctly, he has a duty of care to his passengers, the child solicitors could well sue the driver.... but then the driver could well sue the parent for failing in their duty of care.

ps.. the one thing you should always remember in situations like this is to get the registration number of the vehicle you have to avoid... that is the person whom caused the incident... and direct any solicitors to them....

Personally I wouldn't move unless a child is strapped in. Unless of course there is some reason why they can't be strapped in. I believe it's the drivers responsibility to ensure that the child is strapped in but then I'm not in a petitioned vehicle. Just a little extra note, not that it has been asked for, but I won't move if the person behind me hasn't got their belt on

Toots because you are not a real taxi-driver, you do not understand about working the road. somebody puts their hand out.. you stop... get their destination... and go.... when it's busy.. its job after job... that's why we have so many stickers in the back of our taxis telling the public to put on their safety belts.... :wink:

That, I believe, is the central point. BC has not advised which side of 14 years the child is.

Up to 14 years old: Driver responsible.

Over 14 years : Passenger responsible.

However, given the pick up point, the driver may have valid mitigation if he can show that he was advised of a medical condition exempting the wearing of a seat belt.

I await the outcome with interest.

Mr T I am real I pinched myself and it hurt so I must be real. I also have a proper taxi badge as well as a PH badge. I just have no desire to sit in a partition vehicle, as you well know :wink:

I know you are real... . and very bubbly to!.......But........ you are a real private hire driver.... there is a difference..... hackney drivers are Taxi drivers...... professionals...... or at least should be. most private hire drivers are simply there until they find a proper job...... :wink:

They say most taxi drivers are ugly men and it's nice to have a pretty female driver for a change (I know they only say this so they may get a cheaper fare but it's still nice to hear it). I am professional I can't believe you would say otherwise, that hurts me to the core of my soul I am wounded deeply and to think I thought you was me mate when we got lost together in Manchester :wink:

I always tell them to get their belts on, but at the end of the day maybe not legally but definately real world workings it should be the parent's responsibility to ensure the kid is strapped in, otherwise you could pedanticaly say why not let the kid ride on the roof if the parent agrees to it, which is in effect what happens if the parent fails to strap their own child in.
