Cheers Fella's, on the 3 test ruling, anyone advise about the Legality of the 3 fault ruling? In consideration Manchester City Council employ the testers who obviously are un-independant, thus finding 3 faults is a cakewalk, if they are out to get you, what chance?? Now they say there is no right of appeal on their opinionated testers findings????
If you are failed on an MOT issue, then there is a right of appeal (to the MOT Inspectorate) then & there & the testing garage has to have a supply of appeal forms.
It might be as well for drivers in such Draconian testing areas to find out where their nearest MOT Inspectorate is & their telephone number.
Many years ago in Solihull (almost 20 years ago now), a then trade rep did just that; appealed against the MOT testers findings.
He was at the garage when his vehicle, a black cab, was re-tested on the faults found by the MOT tetser, either that day or the following day (can't remember which now).
He witnessed the MOT Inspectorate's testing assessor, virtually 'tearing a strip off' the MOT tester for being too pedantic & strict.
His MOT failure certificate was substituted for an MOT pass.
So it does work, but you have to act very quickly, then & there & know the proceedure for appealing in detail!!
