Cabbie To Challenge Fashion Police

A taxi driver slapped with a $100 fine for failing to wear regulation knee-high socks will challenge the "insane" penalty in court.

Narangba father-of-three Kidd Moors, 41, was pinged for failing to "dress neatly" after he was pulled over at a roadside breath test site at Hendra, on Brisbane's northside, last month.

Mr Moors, a part-time cab driver, told brisbanetimes.com.au he was baffled by the police response to his wardrobe misdemeanour, which included wearing running shoes with ankle-length sports socks instead of the regulation knee-highs.
"This is plenty weird and I plan to take this to court," Mr Moors said.

He was fined under Section 131 of the Transport Operations (Passenger Transport) Regulations 2005.

"It started with the seat belt - when he (the police officer) stopped me for the RBT I had to release the seat belt so I could put my head outside the window.

"I was about to drive off when he said, `How come you're not wearing your seat belt?' I told him I had to remove the seat belt so he could test me.

"He told me to pull over and I did and I got out and argued with him. That's when he noticed my low-cut socks."

Mr Moors claimed the officer first issued him with a $300 ticket for not wearing a seat belt and a warning about his attire, before slapping him with a further $100 dress code penalty.

"At first I thought it was a joke...I was laughing.

"I walked away with the $300 ticket and said to him I would be seeing my lawyer. I was just about to drive off when he came over and issued me with another ticket for not having the right socks."

Taxi Council Queensland CEO Blair Davies said Mr Moors was the latest victim of a "police blitz" on cab drivers over petty issues prompted by negative media reports about the industry.

"Most of the time our relationship with police is pretty good, but it seems there has been a direction out there either to police or the Department of Transport officers to catch cabbies...over the minutiae," Mr Davies said.

"This is just unbelievable. We just want to get out there and deliver a great service and previously the government was a great supporter of that."

Mr Moors, who also holds down a full-time job during the day, described the debacle as "insane", and said it had caused him and his wife great distress.

"We can't afford this. It's unjust," he said.

"I've been driving cabs part-time for the past 10 years. When was the last time a copper turned up at the airport, where there are hundreds of taxi drivers standing around the ranks, issuing fines because of their socks? Never."

The Transport Operations (Passenger Transport) Regulation states that the driver of a public passenger vehicle must, while driving the vehicle, must be "neatly dressed" or face10 penalty units.

Under Section 132 of the code, cab drivers also face a further 10 penalty units "if a passenger of, or intending passenger for, a public passenger vehicle asks for help to board or leave the vehicle, or asks for help with luggage, the driver of the vehicle must give the help to the extent that it is reasonable for the driver to do so".

Queensland police could not confirm how frequently such fines are handed out or comment on the harshness of the fine.

'Fashion police' Drop Cabbie's $100 Fine

Police have decided to tear up a $100 fine issued to a cab driver for wearing short socks and jogging shoes.

The Taxi Council of Queensland this afternoon welcomed the back-down, saying officers had better things to do than enforce the regulation requiring taxi drivers to dress neatly.

Narangba father-of-three Kidd Moors, 41, said he was initially issued with a $300 fine for not wearing a seat belt when he was pulled over by police at Hendra last month, but the officer's attention soon turned to his dress sense.

The cabbie was given a $100 bill for failing to wear the required long socks and dress shoes, prompting widespread ridicule when the matter came to light last week.

In fact, the Transport Operations (Passenger Transport) Regulation states that the driver of a public passenger vehicle must, while driving the vehicle, be "neatly dressed" or face a 10 penalty-unit fine.

Taxi Council of Queensland chief executive Blair Davies said today the police service had "sensibly" decided not to pursue the fine for failing to dress neatly, but the seatbelt fine remained in force.

Mr Davies said he understood the socks and shoes fine came about after the cab driver had a dispute with the police officer over the laws surrounding seatbelt wearing for cab drivers - which became stricter last year.

"We do expect cab drivers to present neatly and to wear their uniforms," he told brisbanetimes.com.au.

"But we think police have better things to do than go around fining cabbies for not wearing their uniforms."

Mr Moors, who also holds down a full-time job during the day, last week described the debacle as "insane", and said it had caused him and his wife great distress.

"We can't afford this. It's unjust," he said.

"I've been driving cabs part-time for the past 10 years. When was the last time a copper turned up at the airport, where there are hundreds of taxi drivers standing around the ranks, issuing fines because of their socks? Never."

Mr Davies, of the Taxi Council, said police were "not going out of their way" to punish cabbies over not wearing proper uniforms.

"Cabbies have been fined for uniform offences periodically but it's very infrequent," he said.

He has obviously not heard the rhyme "Yes sir,Yes sir three bags full sir! It was obviously one ar$ey cop who was determined to have his own way, which was nothing about law and order.

I never argue with the police unless I am on very firm ground, and then I can be very ar$ey, but there again I have lived in this country all my life and I think I know how far I can go! In a case where they are looking for misdemeanors it is a No No, but this guy is part time and has learnt nothing.
