AliT,

according to what I have been told, City/Central have put objections in to every Live App citing No SUD and if the cooncil are to issue 28 plates then they strongly recommend the names come from the IPL :roll: :? :? :-o

Delighted if it was just yours ali but who knows..dont think it will go as high as what your saying as all the ipl people were sent a letter telling them to apply and that was over a week ago and still only 60 odd now..and whos to say they will even issue that many :-| ..but whatever happens I have no debt so that is a weight of my mind but I feel sorry for others that have recently bought in if they do put on a lot more taxis..

im begining to think crt/city have shares in anderson fyfe.
the reps have no control,and ill tell you another thing i have never seen ppl have such little a grasp of what the legislation is when it comes to licencing as that bunch of halfwits who were at the regulatory meeting the day i was granted.
apperently! me having had and sold a plate was the key to derailing my app

well if youre prediction is proven right! and im not saying its not...i have no idea what the final amount will be.
then it begs the question why all the opposition to this in the first place.

you should have objected stating that as a good reason for denial.

Anyone is entitled to object to any application. The survey says there is SUD and there is no evidence to the contrary. These objections will fail.

Previous legal cases have established that each application must be treated on it's own merits - which means they can't deny an application just because they have already issued enough plates to satisfy the level of SUD identified. Unless there is a different reason to deny (e.g. applicant not fit and proper), each live application must be granted.

The survey says there is SUD, the level isn't important. They must use demand evidence from the time of the application, so until they have actually issued at least that number of plates, any application received must be dealt with in the same way as the ones they already have.
As yet they have not issued any, so any new applications received before the meeting will also result in a grant.

That's if they don't just throw the towel in and delimit.

Reassuring to hear Gusmac, the problem is there is nothing coming out of cooncil HQ to inform any Live Applicants of what they intend to do and what processes they intend to follow, you would expect something if you have just shelled oot £1250 and only have a receipt as proof. From a personal point of view I just want to work my own cab, my own hours, no renting out and self shifted, also to be comfortable in the fact that it is my business and I determine how successful it is by the hours I work. Now I don't think that there is anything wrong with that, but I am sure that you are talked about as the Live Apps list was posted. I don't know exactly how many people have applied but if what you say is fact then if they issue all live apps and the IPL list then I personally do not think that CEC will ever delimit. The cap will be on for good after this situation is dealt with. I am sure that the guys that recently bought in will be [edited by admin] off and I suppose I would be if I were one but an opportunity has arose :shock: whereby legally you can apply for a license therefore you go for it and hope :-| :-|

IPL has no legal standing, as confirmed in another legal case. Those on it must apply or miss the boat.

CEC do not have to tell anyone how they plan to proceed but their options are limited. They could seek to delay the applications but by doing so they increase the chances that even more ppl will apply before they can shut the door.

FWIW (and this is just my opinion) I think they will grant all applications before them at this meeting, so they can close the door on more.
Any applications received before this meeting but too late to go on the agenda this time will be granted later.
Any applications received after this meeting will be refused on grounds of no SUD.

I know whose application I would rip up in front of him on the grounds of abuse of the system.

But I suspect he isn't even a driver, I think he's a suit playing the system for extra that he doesn't really need just to be greedy myself.
