it's all down to choice.... but I never criticise other people's choices.... of vehicle..ps.. if the DDA act goes through.... you might find your choice rather limited .

I seem to remember that when the E7 first came on the market, one was licensed as a private hire vehicle in Liverpool.... maybe it should have been mentioned in court...

But this judgment was won on two counts, the DDA & EU competition. My guess is that if it had been won on only one, the DDA, then Liverpool might have appealed, which would have been interesting if they had. As it is Liverpool had not one, but two hurdles to jump & that was perhaps one too many.

And because it was won for two reasons, it makes it quite strong case law in my book & I don't think any licensing authorities will disregard the judgment when it comes to the crunch. If they do I'm sure Allied / Peugeot & others will issue proceedings.

One of us is confused... it is either you or me.... I am under the impression that Liverpool can still appeal.... the clock started ticking.... when the judges decision was released... and if they appeal they only have to win on one .. for them to win the appeal.. which will cost the other side a great deal of money.....

No.

They will have to win on all aspects of the case, else they lose again.

At the end of the hearing there was a discussion, which is transcribed at the end of the written judgment, between the judge & barristers. In that discussion the judge said he would not be around during August & intimated he might be going to France. He advised council for Liverpool CC that if an application for an appeal was received by his office in writing by 7th September 2009, (the day he was due to return, I believe) he would consider the request. To my knowledge that did not happen + so I believe they are now out of time.

Why do you believe Liverpool CC only have to win on one of the reasons that they lost the judgment on to win the appeal?

It's better than that; it goes like this .....

MR JUSTICE BLAKE: Yes, there is not going to be anyone around to approve it for the next 28 days, I can tell you that.

Then a little later .....

MR FACENNA: You are not around early next week?

MR JUSTICE BLAKE: No, I will not be in an E7 Peugeot vehicle but I might he be headed to where the vehicle came from.
