Woking Council has suspended four taxi drivers

FOUR Woking taxi drivers were suspended pending further investigation last week, for illegally picking up passengers.

At a meeting of Woking Council's licensing committee on Thursday October 1, bosses decided to axe the four men, after a joint operation with Surrey Police.

Earlier this year, undercover officers from both organisations posed as customers and caught four drivers illegally touting for business in Woking town centre.

Despite being suspended, all the drivers and vehicles involved were found to have the correct documentation, badges, plates and safety equipment.

Russell Ellis, Woking Council's licensing manager, said: "We hope that this highly successful operation will send out a clear message to taxi drivers that touting for business is illegal and will not be tolerated. We have every intention of carrying out further operations until we are satisfied that the message has been received and understood."

It is illegal for drivers of private hire vehicles or Hackney Carriages, including black cabs, to approach potential customers for business.

Private hire drivers are only license to carry passengers who have a prior booking, while Hackney Carriage drivers are only licensed to accept fares from customers who have approached them."

PC Simon Praine, beat bobby for Woking town, added:"Taxi drivers are aware of the regulations they must adhere to and their obligations towards public safety.

"Failure to adhere to these will not be tolerated and could end in prosecution. We will continue to work in close partnership with colleagues from Woking Council to ensure the continued safety of people using taxis in and around Woking."

That's what I've been saying for years!!

We are governed by legislation introduced for horse-drawn public carriage transport almost 200 years ago & supplemented by the 1976 Act & bits & pieces of other spurious Acts since 1847.

radio, phone, text and email are all approaches.

what does the act actually say?.... approached in person, in the first person directly?

46 Drivers not to act without first obtaining a licence

No person shall act as driver of any hackney carriage licensed in pursuance of this or the special Act to ply for hire within the prescribed distance without first obtaining a licence from the commissioners, which licence shall be registered by the clerk to the commissioners, [and such fee as the commissioners may determine shall be paid] for the same; and every such licence shall be in force until the same is revoked except during the time that the same may be suspended as after mentioned.


I dont think the act defines how the hire is taken, however, the majority of byelaws state;

The proprietor or driver of a hackney carriage who has agreed or has been hired to be in attendance with the carriage at an appointed time and place shall, unless delayed or prevented by some sufficient cause, punctually attend with such carriage at such appointed time and place.

The above suggests the vehicle can be pre-booked, therefore the means of how it is pre-booked does not need defined.
