My point was that the council by introducing this set of crazy licensing conditions, (which as they relate to Hackneys should in fact be byelaws), have used the age old strategy of 'divide & conquer' to the cab trade & the cabbies have not seen through it.

Any sensible old-timer cabbies would have pointed out to the council the errors of their ways & tried to prevent these injustices.

As it is they are now at each others throats instead of working together. Perhaps the council wanted to de-stablise the cab trade as a precursor to delimitation.

Also, these are obviously conditions of licence for Hackneys, because if they had been added to the Hackney Byelaws, then any additions would have had to be passed by lawyers at the DfT & these wouldn't have been.

So that begs the question; is this one of the councils that still erroneously attach conditions of licence to Hackneys instead of Byelaws?

I wonder if that's the DfT way.

£78 for his book & I don't know if I'm doing the right thing.

And ..... WTF are Conditions of Application.

He must have done his Articles & studied in Brum ..... nowhere else could any person learn these strange ways.

He learned them in Manchester.....I understand we have him to thank for a number of courst cases he lost.

read Brentwood vs. Gladen....he's nemed in person.....little wonder he took offence and gave advice to Berwick council.

Conditions of application........you have them in Brum surely.

I am of the opinion that they should both be byelaws.

Talking about Button ..... there's a solicitor down in Wales somewhere, that used to be a cabbie until he qualified as a lawyer. He won quite a few cases for individuals, including one against a council that tried to imposed conditions of licence on Hackneys. The judge confirmed that byelaws should govern Hackneys.

He had a website called 'Tapin2taxis' or something like that, but it's no longer online.

Now he was good! Hadn't been a solicitor that long, but with his cabbie experience, coupled with his knowledge of LO garbage, he knew both sides of the argument.
