IMO no.

The way I see it he will as he will be doing it for hire and reward, especially for the airport transfers alone
Then there is the pick up to take them to there destination on top of yon there hill

Surely they are just renting the bikes and following the leader by their own pedal power.

I dont know if they bring the bikes with them but if not he is still running a taxi sevice as he takes and picks them up at the airport then he is on call to take and pick them up from where they want to go or be, to return them to the hotel or B&B

If he is transporting them to the bikes or routes then he does need licensing.

Maybe if you had elaborated a bit more in the opening post we wouldn't have wasted minutes of our valuable life pointing out the bleeding obvious.

LICENSING OF TAXIS/PRIVATE HIRE CARS AND DRIVERS

EXPLANATORY NOTES.

There is no requirement to have a Licence if the vehicle is :-

Being used under a contract for exclusive hire for a period of not less than twenty four hours.

(Exclusive hire means a written contract with a particular individual or group totally and no other, excluding all else and unshared)

You can have the contract, but you can only have one contract at a time.

The contract must state the time the contract starts, and the time it finishes, and no other contract can take place within the time-scale of any existing contract.

If it was that easy to pi** over licensing laws, then everyone would.

I'm at a bit of a loss here - is there a suggestion that I am attempting to break the law in some fashion?

For information, and avoidance of any doubt, I am operating entirely within the requiremnents set by my local council, having discussed it at length with their enforcement team.

It was us who were in the process of obtaining a private hire vehicle and operators license, when after further consultation the council agreed our operations came under the terms of exclusive group hire and were thus not required to be licensed by them.

Should we at some future date change business direction, then an operators license may be a requirement.

The contract exemption is something that was put in the Scottish act, and the earlier English act to help out people who did certain one off runs.

As the English one was abused by folks not wanting to mess around with all that licensing lark, a mass of case law was built up, and in the end the English exemption was repealed.

Clearly up there things take time.

My previous post is where case law was before the English exemption was repealed, and that would be persuasive in a Scottish court.

The fact that your council told you to use the unlicensed unchecked route is a disgrace, but that's not your fault. That said I think it would be better if you got licensed.

In so far as I am concerned Gowhere Scotland you should contact scots borders council a couple of times a day for the next 6 months complaining about the wheelchair provision of taxis.
