Should be an interesting court case, although Mr Griffin wouldnt be driving the vehicle and committing the offence.

In so far as I was aware a court will look at the offence and decide if the driver is guilty.

Whether or not the law is right is the job of Parliament aint it......not the court.

ffs.....I thought with the legal might of Mr Griffin and his GMB cohorts would know that :roll:

The courts will decide if the driver is guilty or innocent of an offence, but first it will have to assure itself that the offence before them is an offence they have powers to deal with, or is a lawful offence.

The UK parliament can set down whatever laws they see fit, but if they aren't in accordance with EU laws, then they are not enforceable.

It would be an interesting ruck to follow, but I'm surprised at the amount of tickets they seem to be letting go.

Maybe they aren't. :?

I'd personally like to thank you Don on behalf of the London Taxi trade.

If it wasn't for the information you provided to me, we wouldn't be in the good position we find ourselves in today. These hints and snippets of information were invaluable.

When/ if the Bromley consultation starts, we'll be in a better position than ever to place our objections before the committee as major stakeholders, as will the Bus companies.

So thanks Don, you're a good egg, if it wasn't for you, it may have slipped through our radar until it was late in the day.

From receiving a ticket to appearing in the local Magistrates Court can take anything from 6 months, to a year.

I don't think they'll walk away that easily.
John Griffin is a Minicab driver, not the law lords.

There's many within his own industry (and company?!) that would like to see him drop a bollock on this one. :wink:

Entering a controlled Bus Lane in a vehicle type prohibited from using same.

The sign says 'Bus, Taxi, Motorcycle'

Minicabs are not Taxis.

Minicab drivers who have entered the controlled lane, issued by PC's from the Mets RPU.

I would imagine the original traffic order mentions 'taxis'.

But I would also imagine that traffic order doesn't define what a 'taxi' is.

I'm quite please that this issue is being taken up with a mush with money, rather than a lone driver and a few of his mates giving him moral support, which is often the norm.

Grieg.your very welcome ,however powder is still dry ,the dampness referred to earlier could be down to black cab driver reps pis**ng themselves with FEAR over this issue. Fifth columnists job(to confuse the enemy :wink: and infiltrate,and supply mis-information) JOB DONE!!! good ain't it.You know only what i intend you to know. :lol: :lol:

The TRO describes a taxi as;

"taxi" means

(a) in England and Wales, a vehicle licensed under

(i) section 37 of the Town Police Clauses Act 1847[16]; or

(ii) section 6 of the Metropolitan Public Carriage Act 1869[17];
or under any similar enactment; and

(b) in Scotland, a taxi licensed under section 10 of the Civic Government (Scotland) Act 1982[18];

Mr. Goodwill: To ask the Secretary of State for the Home Department how many prosecutions have been brought for illegal use of the M4 bus and taxi lane since the lane was established. [293133]

Mr. Alan Campbell: This information is not collected centrally. Court proceedings data held by the Ministry of Justice do not separately identify offences of illegal

use of bus lanes (under Section 36 of the Road Traffic Act 1988 and Regulation 10 of the Traffic Signs and General Directions Regulations 2002) from other offences of neglect of traffic directions. Nor is the location of such offences recorded.

Mr. Goodwill: To ask the Secretary of State for the Home Department what arrangements are in place to monitor compliance with the terms of use of the M4 bus lane. [293134]

Mr. Alan Campbell: The police can deal with illegal use of the bus lane by giving an oral or written warning, the issue of a £60 fixed penalty notice or by proceeding to prosecution. Metropolitan Police traffic officers are regularly deployed on that section of the M4 which includes the bus lane. Any police officer who witnesses an offence taking place there will take whatever action is appropriate in the circumstances. In addition, the Metropolitan Police are working in partnership with the Highways Agency and Transport for London to devise medium and long term solutions in relation to the lane’s use and safety. :lol:
