Any body know who would be the data controller,you fit subsidised cctv,the council keep the key for harddrive have the password and remote control the only thing the owner can do is start it a shift start and switch off at shift end, by the way the data controller has to pay £35 annually,meaning if the owner is the data controller he pays £35 to be in charge of turning it on an off which is controlled by the cabs ingnition so really you have no control but still pay £35 GOOD HEY.

Thats a damned good question.

This CCTV thing tends to bug me a little, I wonder if my local newsagent has to ask his local council to keep the data? Somehow I dont think so.

Why should the cab trade be any different?

if council have control of the data surly they should be the data controller, not according to the pillocks at data protection office, they say the owner of the cctv is responsible, if thats the case why do the owners not have the remote,password software to download the imformation if asked for by the police, no done by council i,m going around in circles getting nowhere but inbetween i`m liable for not being registered,

read it its like knitting fog took the short cut rang them still like knittig fog did not get a definative answer, i always thought he who pays says but no you have to join and have no say, the reply they gave me was if you dont want to pay dont fit it, very helpful.

Reading through the rules regarding pubs and clubs under the licensing act 2003. It would seem that the individual licensee is the data controller.

Normally these things are the same for all licenses.

I would suggest that the licensee of the vehicle is responsible as a data controller and the local authority has no right to access any images.

I wonder how many local aiuthorities have made it a condition of license that those vehicles fitted with CCTV provide a copy of their license as a data controller?

Although I'll be interested to read the reply of the ICO.

The council doesn't control the data you do, or will.

The council can ask for access to see your data, and the police can gain an order to view your data, but under the act you are the data controller.

However as you are a sole trader, or single user of data, you don't come under the act.

Thus no license is required.

You can see what i mean now i think two people and myself have read what is written about the subject and both differ in opinion, along with one of the managers at the dpa or ico as they are now named who stated in MY OPINION not much help from them.

I would say there are several thousand CCTV units in taxi/private hire vehicles.

I would also say none of them, other than maybe one or two, are registered with the Data Protection folks.

And I would also say I have yet to see any record of any driver being prosecuted for not being registered.

The only people who have access to our HD's are the CCTV control staff and the Police.
