Just out of Hypothetical curiosity, Say that due to 6 inches of lying snow and the roads in and out of an operators Town being untreated and virtually unpassable (unless you own a 4x4 Vehicle) with more snow falling and even more forecast....you have to make a decision to cancel the few pre booked runs covering the next 24 hours, you do so with your customer safety and your own safety in mind.

None of these runs paid for in advance. What rights would a customer who lived in a snowbound and difficult to reach village have to compensation from an PH or Taxi Operator having to cancel their run due to bad weather and dangerous road conditions. matters made worse if they had a train or plane to catch or a short break booked.

Is an Operator Liable or it deemed to be beyond the operators control.


It hasnt Happened, but it made me sit up and think of what could happen in this claim driven society of ours.

I take it that you don't have any terms and conditions that you work to?
In our terms and conditions it specifically states that we can cancel jobs due to inclimate weather. As far as I know the customer has no right to compensation other than the return of any fare that they may have made beforehand. If a journey is so important that failing to make the trip would mean some other kind of loss, say missing a flight, this should be covered by the customers travel insurance.
I have written several letters for customers to submit to their insurers in support of claims for losses or additional expenses where flights have been missed or delayed.

All I can see in our term and conditions is "Unless prevented by sufficient cause"..I guess that covers such eventuallities

Besides....any plane, train, boat or holiday would have been booked before hand and any Taxi or PH would not have been a consideration until afterwards...therefore any taxi/ph cancellation would not have affected the clients prior engagements as that was a secondary action.

It would still be covered by the customers travel insurance the same as hotel charges are covered.

A court will view the reasonableness, or not, of the cause of the cancellation.

Airlines don't get sued if planes can't take off due to iffy weather, and the same would apply if you couldn't fulfil your pre-booked work.

Clearly if the customer has paid a deposit, or the full amount, prior to the cancellation, they will be entitled to a full refund of the monies they have paid.

But nothing more if the cancellation was due to treacherous weather.

Might be handy in or around Skips parish....its a cross between the Rockies and the Bronx out there.

Could have done with one for the last 2 weeks, its not fun driving in 6 inches of snow every day, council ran out of grit and we are to get more over the next 2 weeks
There is hardly any loss of economy as they run in normal 2 wheel drive unless the 4x4 system is required and you wont know its even engaged until you sale past all the other stranded cars
It was minus 12 when I parked up tonight and the roads where like glass
