Cc very good article in this mouths meg, and in fact i have stared to do somthing about the use of taxi being used by p/hire.

at the association request Burnley changed there conditions,

19. Apologies
Apologies for absence were received from Councillors Frank Ashworth
and Tony Lambert.
20. Minutes of the last meeting
The Minutes of the last meeting held on 8th September 2009 were
confirmed as a true record and signed by the Chair.
21. Public Question Time
Mr Charles Oakes attended the meeting and addressed the
Committee under the Council’s Right to speak Policy on the
agenda item relating to:-
Amendment to Private Hire Operator conditions.
22. Amendment to Private Hire Operator Conditions
Sue Graham reported to consider a proposal to amend Private Hire
Operator conditions.
Licensing Committee Date:- 05th November 09 Page 2 of 4
She indicated that the Town Police Clauses Act 1847 defined what a
Hackney Carriage was, and since that time various Acts, when using the
word ‘Taxi’, had made it clear that they were referring to Hackney
Carriages.
She stated that it had been noted that Private Hire Operators had begun
to use the words ‘Taxi’ and ‘Cab’ in their business names and on door
signs on their private hire vehicles.
She added that a consultation letter which detailed the impact of any
changes on existing licensed operators was sent out and the response,
in the form of a petition raised by the Private Hire Association and
signed by 28 of the existing 42 operators was submitted.
Members made the following comments:-
• That the proposals would incur expense for Private Hire
Businesses, but the interests of public safety were
paramount.
• That the word ‘Taxi’ or ‘Cab’ should not be used by Private
Hire Operators as it was only misleading.
• That Private Hire Operators should not use the word ‘Taxi’ or
‘Cab’ unless they had Hackneys in their fleet.
• This proposal would enable the Public to see a distinction
between Hackney Carriages and Private Hire Vehicles.
• As proposal would mean changing company uniforms, shop
signage, letter heads, business cards, etc, would it be
possible to allow a certain time period so that old stock was
used.
• Would it be possible to compensate Private Hire Operator
firms for their expenses incurred by the proposed change
• Would reference to Private Hire Operators under the ‘Taxis’
heading in Yellow Pages be allowed.
Sue Graham advised that the Council enforced a number of conditions
on licensing, and the Council could not afford to compensate firms, and
that the proposed condition only affected a small minority of Private Hire
Operators.
David Talbot stated that the proposed condition would not stop any
Private Hire firms being included in the Yellow Pages under the heading
‘Taxi’ or ‘Cab’.

RESOLVED That the following amended condition be approved:-

And this association will do more this year.

Yes Charles, you have done a good job in Burnley in respect of the condition, lets hope other councils take note.
