 Post subject: Temporary Badge Query

Just a quick query. I was due to renew my badge beginning of January. Due to my moving and only just informing the DVLA I haven't received my drivers licence with the new address on it. The licence department gave me a temporary badge for 2 weeks which had to be extended another 2 weeks because I still haven't received my new licence. Today I had to renew my temporary badge again which they have done but they say I can only have a 1 week extension. Obviously my concern is if I still haven't received my licence by next Friday the licence department will not issue another badge to me. I asked if I could appeal this decision if I haven't received my licence and they said yes. I then asked if I could keep my badge until the appeal is heard and was just told that the next meeting was due on 26th February next. Does anybody know if they can refuse to issue another temporary badge if I lodge an appeal if necessary?

Hassle the DVLA, i had a similar problem and i had to tell the dvla the urgency and name of the licencing officer and authorise them to disclose my licence details to him then the licencing officer had to phone the dvla and they gave him my licence details over the phone and told him that another licence had been issued to me and was on the way and all was fine. The only problem was that the dvla number was a 08?? number and the councils phone system would let them ring it so i had to take my mobile to them for them to phone it. Surely they will allow you a bit of leeway the only time they dont round here is if you are one of the ones that cause them hassle now and again and then they can be aukward.

Not if a court tells them not to.

Get your solicitor to prepare an application to the Mags Court, or do it yourself.

In the meantime find who the chair of licensing is and ring him/her up.

My understanding is that refusing to renew your temporary badge for without a good reason is not allowed, but if they do then the LGMPA 1976 gives you the right of appeal to magistrates within 21 days of their giving you their formal decision (in writing). Once the appeal is lodged, you may continue to work until the matter is resolved. It is not as if you have wilfully refused to present your licence to them.

Toots.... Go to see your local MP.... it is actually part of his responsibilitie as an MP to act on your behalf with the council and the DVLA... you'll find a few words from him will soon have them singing a different tune....

ps...MPs are ever so useful at times..... and they cost you nothing...... very eager to Help...... especially at election time....... :wink:

Skip I do have my original but it doesn't have the correct address on it so they won't accept it that's why they have put me on a temporary badge

After 6 weeks of Temporary badges they've finally let me have my yearly badge because I finally received my licence from the DVLA last Friday. My vehicle has now been called in for inspection by the enforcement team (which is 2 of our LO's) so I have to make sure it's all nice and clean (which it always is) and I have to produce a copy of my insurance which they already have on file. All I ever wanted was a quiet life :lol:
